Ok I'm not sure where to post this. I posted on another forum but I don't think my question was related to it.

I'm going to try to make this sound as simple as possible so please bare with me.

My husband is from Mexico and came to the US illegally in 2009 when he was 15 years old with his mom, brother and sister

(hes 21 now.) We have been together for 3 years and have been married for two months. We have one child together who was born in March of 2015.

Today we spoke to an immigration lawyer about what we can do about my husband's status in the US. He told us that we need to file an i-30 and then wait to be approved. He also said something about a waiver and we needed to prove extreme hardship if my husband were to get the ten year bar. This is where I get confused.

If we file for an i-30 and it gets approved do we still need to do the waiver too? There was so much he was telling us I was trying to keep up but that's all I could understand.

Our lawyer also told us that most likely my husband will be approved for the i-30 and that he will have to go to Juarez, Mexico for an interview.

If anyone has any experience like mine could you please help me out. Thank you so much!!!

I think he did but I honestly don't remember. He was telling us so much stuff and when he mentioned my husband going to Juarez I was having a hard time because it scared me. We see him again on Monday so I will make sure to ask him.

I'm glad you mentioned DACA because at the beginning of this year my husbad, his mom and brother and sister went to the same lawyer to apply for DACA. Everything was going great until I think they put it on hold so we had to just wait. We never heard about it again until we spoke to the lawyer yesterday.

I'm not sure about your last question. Do you mean did we hire him as our lawyer? If that's what you're asking then yes we did. We put down a $4,500 down payment to get the i-30 process started. The total cost of everything is $12,000. But since we paid $4,500 we only have $7,500 left to pay which we'll be making $500 monthly payments.

Ohh dear assuming no complications, criminal history etc, that is way too much.

How could his mother qualify for DACA?

Now I do not know your full details but for a simple case get DACA, get AP visit Mexico, come back and file to adjust, easy peasy no waiver needed.

Really? Oh wow that's not good to hear. We were referred to this lawyer by my husband's friend. It would've costed $15,000 but since his friend referred us the lawyer took $3,000 off.

I'm sorry, his mom actually wasn't applying for DACA it was just my husband and his brother and sister. His mom was just there to help them out.

Lawyers are no different to plumbers, but too late now I guess.

Yes. Do the 130 first. Once approved which can take 6 months or longer, you then do a 601. That is the pardon. Do not let him go to Mexico without it. If he does, he may not be able to come back. Extreme hardship can be in different forms so it is not hard to prove. Unfortunately he does have to go to Juarez for the Interview and wait for the visa to be able to come back in.

The reason we have this lawyer is because, as I stated before, my husband's friend referred us and his friend was able to get his green card going through this same process along with other immigrants as well. This is one of the best immigration lawyers in our city and we feel lucky to have him help us. Money is not an issue in this case, we can pay the lawyer.
