how does nvc work and what to expect?

Hi all,

So today my I130 pettition is approved at the uscis hoerah

Who can write down what the steps are next...

I guess uscis sends it up to the nvc but how doesthat proces go's

And what can i expect and see

And are there any tips and or ideas on the road?

After a couple of weeks call the NVC to see if they have your case yet if they do ask them for your case and invoice number. If they do not have it yet you can wait a couple of days or a week to call them back. The NVC number is 1-603-334-07000. They are open 7am to midnight EST. the best times to call is early in the morning right when they open or late at night before they close. first time you call you will need your USCIS case number

After you get the case and invoice numbers you can log onto the CEAC( Consular Electronic Application Center) and start the NVC process

First you will fill out the Ds-261 choice of agents form and paid the AOS fee. Then you should send in both the AOS and the IV packets together. You will need the document checklist from the NVC welcome letter and the Bar code cover sheet. or you can print a barcode cover sheet from the AOS payment portal. Send both packets together to the same address.

It could take 30 days or more for them to review the packets after you send them in. One part of the NVC process is reviewing of the Documents

The second part of the process is reviewing of the DS-261 choice of agent form ,paying the fees and filling out the DS-260 form. This can be done while you are waiting for them to review your documents. First thing is your DS-261 form needs to be review and added to your case as the IV fees will not show. If the NVC has not review it yet. You can call and have them do it over the phone. After they review the DS-261 choice of agent form then you can pay the IV fee, then fill out the DS-260 visa application form

Do i file ds261 as the applicant or does my husband (the partitioner) need to file that one?

I guess he needs to pay all of it due the fact he is in the usa so transferring money is faster and easyer?

Will the whole procces leads it self? Or do i need to go after certain things?

He putted in the aos together with the i130 so how does it go then?

He told me if you apply them together you dont have to pay aos fees is that correct?

The ds-261 is the choice of agent form. You will assign someone that you will want the NVC to send correspondence to. It is usally better to make the US petitioner the agent. However it really does not matter as when you call the NVC to get the case and invoice numbers you can give the NVC both your and your spouse E-mail addresses and both of you will recieve E-mails from the NVC

I am confuse as to why he send in the AOS with the I-130 form

that can only be done if the foreigner is already in the USA and marry a US citizen

If you are still in your country and he is in the USA then he should not have sent in the AOS with the I-130 petition

Also AOS means two diffrent things

one is affividite of support which is neede for the IR-1/CR-1 visa

the second meaning is adjustment of status which is not needed for the IR-1/cr-1 visa but is needed for the k-1 fiancee visa after the couples get married in the USA, or if a foreigner gets married in the USA they will have to adjust thier status

It seems like your husband might of confuse the two
