Hello Vjers,

Somebody told me today that a naturalized citizen can have his citizenship revoked if it is found that he/she has no intent of staying in US within the first year after oath.

Is it correct?

For example, somebody becomes citizen in 3rd April, within one year, he/she leaves for his/her home country and stayed there.

This is a former provision of fraudulent naturalization. The former INA 340(d), as originally enacted in 1952, said that if a naturalized citizen took up permanent residence abroad within 5 years of naturalization that the person did not intend to reside in the US and thus naturalization was fraudulent. This was amended in 1986 to be taking up permanent residence abroad within 1 year of naturalization. And this section was repealed by the Immigration and Nationality Technical Corrections Act of 1994. There are still (currently) other provisions of fraudulent naturalization in the law, like joining a terrorist organization or Communist or totalitarian party within 5 years of naturalization.

In addition to all what was said above, I also know a few people that got naturalized while living overseas with no intentions of moving to the USA. They were kids of US parents.

Those are not naturalization cases. They were born us citizens because of parents transmission of citizenship.

That may be correct however I recall that the word the US embassy used at the time for them was "Naturalization". The point here is that you don't need to reside in the US to continue being a US citizen.
