Same gender K1visa

I am engaged to a gentleman in Brazil. Neither of us has been married, has no children nor criminal records. I foresee two obstacles in our way: (1) He is 29 and I am 61, and (2) we met only in April of this year (2015). There is absolutely no doubt about our commitment to each other (neither of us was looking for a relationship, but we both found our soul mate in each other and we both just "knew"). I am an airline employee and have been to visit him four times, and can provide proof of those visits as well as proof of our daily communications. Originally our plan was for him to obtain a tourist visa for a true, bonafide visit to the US, then return to Brazil, and then apply for the K1 visa. However, his tourist visa application was rejected two days ago after he was honest and told the consulate person he was coming to visit me as well as see some of the US. [Another story of discrimination entirely. Only two questions; he was rejected before the interview, I'm sure].

My question is, what would be the chances of obtaining the visa without representation? And could an attorney help?

Unless you have additional issues, no I do not believe an attorney would help (other than help spending your money). Yes you could face some hurdles with the difference in age, but that does not mean your visa will not be approved. Make sure you include proof of all your visits in your K1 application. And when the time comes for the interview, be prepared that they may ask questions about your age difference.

The US tourist visa denials should likely have little adverse effects on your K1 visa petition and subsequent visa application. Be sure to , easily accessible at the top of the forum page. As you already mentioned, the age difference will likely be an issue at the interview, be prepared for scrutiny on that issue.

Your age difference and short courtship might raise some red flags, but I doubt the same-sex aspect will matter: plenty of same-sex K1s get approved with no problem. We are a same-sex couple too.

You will need to build a convincing case that you have a bonafide relationship, I would suggest front-loading your application with as much evidence as possible. Be prepared to be questioned about your age difference at the interview, definitetly. However, big age differences aren't that uncommon, so you if are well prepared you should be fine. I don't think an attorney will be much help in this case as they can't produce the relationship evidence for you. Good luck!

Same as everyone else on here, be prepared to have your fiancé explain the difference in age at the interview. I might add considering being there for the interview to support. Even if you are not allowed inside, your fiancé can let the CO know you are outside and happy to answer any and all questions. Good luck!
