Hello all!

We received Packet 3 in the mail today, the embassy in Spain is working really fast... I can't complain but I just never imagined it would be so fast. So I am a little behind with the co-sponsor thing. (I-134)

Here is my question:

1) I have two possible co-sponsors (and Yes, I will be needing one, I am a student in between jobs right now) My father and my aunt.
My father is barely over the 125% and my aunt is very very over the 125%. My father lives in my state, in fact we will be living in his house, and my aunt lives in another state. I can't decide who to use as the co-sponsor. My father previously has submitted a visa petition for his other two daughters but he never sponsored them and my aunt has never submitted anything for anyone. This decision is holding me back.

2) For question number 10 is says * I have submitted a visa petition(s) to U.S. Citizenship and Immigration Services on behalf of the following person(s). If none, state "None".*

- is I-484 considered a visa petition?

I would go with the aunt who has a larger income and never filed for anyone before. They do not have to live in the same state as you. It can be anyone over 18 residing in the US that is a USC or LPR.

I do not know what an I-484 is. If you meant an I-485, then that is a not a visa petition. That is an application for permanent residency. The I-130 would be the petition. How did he petition his daughters without supplying an I-864 to sponsor them?

Hey KayDeeCee, thanks for your reply!

Some years ago I applied for my now ex-husband with the I-485. He mainly did the paper work and kept me out the loop for most things. He grew up in the States which is why I applied for him here, we never did the I-130 or K1 because we met here and he was already living here for many years before. I was asking on my behalf, since I believe I also have to fill out the Sponsor form even though I do not have a great income right now.

My father used a co-sponsor for his daughters, since they have children his income was not big enough for all of them. Co-sponsor was easily accepted.

To file AOS for a spouse within the US, you file the I-130 and I-485 concurrently.

Having a joint sponsor does not mean someone did not sponsor who they petitioned for. The petitioner is always the primary sponsor, even when using a joint sponsor.
