Have you looked into the cost alone for all this? Of course, your bf will pay for the petition, which at the moment is $170 I think. You would be responsible for your medical, visa cost, etc. Medicals range in price and I won't even begin to quote a price. Then there's the flight here. You say you know for sure the requirements of the state in which your bf lives in regarding marriage. I really hope you have researched this. IF you need your parents consent, will you indeed have it? In writing and notarized?

IF you get so far as the NOA2, which is the approval of JUST the petition and NOT the visa itself, there is the interview at the consulate. Have you thought about that and what the AO will think when he or she sees your age? What answers would you have ready for the multitude of questions this person can ask? What if this person doesn't believe you if you say you love your fiancé and thinks you are using this as an escape or worse, to obtain a green card?

I'm not saying any of this will happen. It is only suppositions. Possibilities. You do sound as if you have thought about this a lot and you surely aren't the idiot that another poster alluded to. Still, and I do have a lot of sympathy for your home situation, it would pay to think about this whole process. Go to the Australia forum here and ask questions about the consulate. This journey isn't a quick fix for a miserable home life.

I was wondering about that. Seems like a 16 year old high school drop out would be a red flag to USCIS, but I didn't want to ask.

I'm the USC in my relationship, and my husband was already here, in Florida while I was in NY. Our situation is maybe a little bit backwards, as I moved to be with him, and just moving 1300 miles within the same country was difficult. I couldn't imagine doing one country to another at my age (20) much less 16. Seems like the main motivation here is escaping something, and no matter how true and sad that may be, it's an awful way to start out of a marriage ESPECIALLY when dealing with immigration stresses and moving to a new and unfamiliar place, dealing with the boyfriend's family dynamic, and being barely employable.

While this is a place for help with visa information, etc. when presented with so many red flags, an analysis of the relationship is going to happen.

But the other posters' ideas were posted senselessly, as she didn't want ideas, just a "go get a K1!" response.

i'd actually like to reiterate that i came here for visa information and options, not an analysis on my relationship and certainly not to be called names.

i'm aware that i'm young. i know that it's not considered wise to be getting married so young. but i either do this, or i stay here for another two years. and for the risk of sounding like a stupid teenager to all of you, who'll probably think i'm blowing everything out of proportion, i'm not going into why i can't stay here.

all i came here for was some information on what to do, because i didn't know where else to ask.

i looked into student visa options while i was still in school, and my parents said they wouldn't pay for it.

i don't know how much my boyfriend is paid, but i know it's a lot more than $8 an hour. =/

it's perfectly alright for some of you to blame my hormones for this, i expected it. but that does not make it true.

I really would like to say something about your case and i thought you said "ideas appreciated" but reading from the ones who responded to your post and your reply didn't quite match at all. Darling, the people whom you are asking opinions or "ideas" doesn't mean something bad on you, for all they care BUT these are people who are steps ahead of you and they know what they are talking about( especially for the visa information).

You decide at the end what path you are going to take... either go for the K1, CR1 or student or whatever... but just know that there are risk in everything you do. One major thing might hinder your application is your age. US goverment is weeding out people that eventually becomed a public charge later. And they will also question if you really have a geniune relationship with these man or not or else they will put you under administrative review and hold your application. You think about that and you decide.

As for me, I will not advise a young person of 15, almost 16 to go out and just get a K1. Too many factors are involved with that journey to give out a flippant response such as that. If that's the response she wanted, she came to the wrong message board for that.

I agree; I wouldn't either. My fiancé and I don't even live as far apart as most people in a long distance relationship (flying is only one to two hours, driving might be about 7 or 8!) but going the K1 route was a very big decision even for us. I can't even imagine what it is like for people who are on opposite sides of the world, let alone very young.

Personally, if I were you, I don't think I'd go the K1 route.

Sounds to me that you're using your boyfriend as an avenue to escape your life. Also sounds a little odd that your bf's family is supportive of this relationship...after all, you're 15 and he's 20. A 5 year age difference is no big deal once the age of majority is met, but thinking about say a 13 and an 18 year old...that's just leaps and bounds apart.

However, I'll give you ONE piece of sage advise that you should really consider. Stop looking towards other people to change your life for you. Do it yourself. if you're old enough to get married, you're old and mature enough to be responsible for your own life...even in Australia. So stop hanging your hat on 'oh my dad this, my mom that' cos let's face it....if you want to be considered adult enough to marry, you really should act like one...which includes taking control over your own life. You're essentially looking at your bf as your 'way out' cos he's gonna marry you and take care of you, and his family's gonna give you a job...but WHAT HAPPENS IF....everything is not what it seems? What are you going to do at 16, 17 here in America if you are completely dependent on others? How could you provide for yourself?

Read this website carefully. Read how hard some of the obstacles are...especially when the harships you have are not even added into the mix. Read this:

The cost of your coming to the U.S. is going to be high for your boyfriend. If he can pay for that, maybe he can pay for you to continue high school in the U.S. even though your parents were against that. There are a lot of programs for exchange students. You say you know that 16 is too young to get married. Honestly, it pretty much is. Regardless of how mature you are now, you're going to be different later, which is what you don't want to hear, but it's very very true, no matter how bright and articulate you may be. There ARE other solutions besides the K1 and I'd almost rather see you go overstay your VWP in the US than get married (although I would not advise that since it's illegal). Take more time to think about ways to get student visas.

If your fiance really loves you, he will start considering a move to Australia for the next few years as well. Has he considered that at all?

eta: I think Lisa's advice was really spot-on. Either you are a victim of your parents' circumstances (and you are not yet adult) or you are an adult ready for marriage. It can't be both, and personally I think you have every right to be struggling with your home situation and not be past it yet.

at what point did i openly say that i wanted anyone to give me a "go get a K1!" response?

as far as i knew, at the point i posted the topic, this was the place that had the best chance of giving me some idea of which road i should head down, be it K1 or a different type of visa. i never said i was only open to one, and if you read the entire topic, you would have noticed that i posted a short while back saying that the CR1 option looked like the best idea, but i still wasn't sure how to go about it.

i'm not using my boyfriend as an escape, i love him and his family, and have done for almost a year and a half. i admit freely i want out of here, but who exactly are you to judge me when you don't know my exact circumstances at home?

in a couple of weeks he'll be here for two weeks, and then when my passport is renewed, i'll be visiting him for as long as i can stay on a tourist visa.

so right now, this isn't immediate.

thank you to everyone who has provided me with information i can use, as opposed to namecallers and people intent on analyzing my motives.

If you are thinking the CR1 is the best, check out that forum. We can only really help with K1. Good luck on whatever you decide and I hope you have a wonderful visit with your SO!

Some people might have thought you wanted a "go get K1" response, since you posted in a K1 forum AND to most people who replied, it probably sounded like you wanted to get the K1 as soon as you turned 16 - sometimes the Internet isn't the best form of communication - that's nobody's fault.

Personally, I didn't think that you were asking for a ''just go get a K-1" as some suggested, but given that it was posted in the K1 forum, I can sort of understand why others might have. I do remember you posted that CR1 seemed like the best option but I have no clue what it is.

I don't think people who suggested that you were maybe trying to escape something (and you admitted yourself that you want out of there and hinted that things were bad for you, so it was not an unfair assessment) were necessarily judging you. You can't really blame people for analyzing your motives, or your boyfriend's motives.

I don't think people who are analyzing your motives are judging you; there's a difference between warning against something for your own good based on what you've shared, and judging you. Like I said before, NO ONE knows your situation, you might have good reasons, you might not.

I think the main message people were trying to give you is simply that it probably isn't a good idea to get married so young (since you asked about getting a K1 and what it would take - it sounded like it's what you wanted) and move all the way across the world, and no one really know how to say it properly.

I think for this thread, there just have been misunderstandings that often occur due to the lack of tone on Internet. I have sympathy for you and the others who posted on this thread - I used to run into this problem with people online misunderstanding me a lot!

Opinions are just that. Its all we can give because we are not immigration lawyers - try one of those!

Or ignore all the good comments on here and be upset by the bad ones, then go get a k1, get married and have three kids by the age of 18. Most of us will still be using this site at that time (this is a long, stressful process) so come back and tell us how wonderfully it has worked out (no accounting for tone of voice). I sincerely hope it does, whatever road you choose, as you seem to be deserving of a bit of happiness.
