Dear all,

A rollercoaster of emotions here. I received notice earlier in the week that my 129F petition was approved and I'm currently waiting on NOA2 to be delivered to my house.

The approval followed a Request for Evidence due to my having used an expired form for the biometrics for myself and my fiancée.

As it turns out, I just realized today that I submitted the Request for Evidence without my foreign fiancée's Biometrics attached! Yet, the petition was approved.

I'm not sure who I should contact or whether I should contact anyone at this point.

Mainly, I'm wondering if I should just keep my fingers crossed that the NVC will forward the packet to the Embassy and that my foreign fiancée brings with her to the interview the missing biometrics. I am concerned, though, that the embassy may reject everything and jeopardize the entire process.

Any (and all) help would be much appreciated.

You mean the G-325A biographic info forms?

How could you get an RFE for expired forms when all previous editions of the G-325A are accepted? > http://www.uscis.gov/g-325a

If the petition was approved, then it was approved and will be sent to the NVC to get assigned a case# and be sent to the appropriate consulate. Not sure how they could reject it for using forms that are accepted.

Beats me KayDeeCee.

The RFE only said that we needed to submit correctly completed G-325A forms. After much examination of the forms and the instructions we were convinced that the forms had been filled out correctly, the only discrepancy being the original forms had an expired date on them.

We proceeded to copy all of the information to the new forms and submit, at which point my fiancee's G-325A was mistakenly omitted from the packet.

Now, with an approved petition and a case number pending, several questions linger.

1) Does the NVC further review the packet and could they reject it if in fact my fiancee's G-325A is missing?

2) Does UCSIC remove "incorrectly completed forms" from the packet they send to the NVC?

2) What could happen if the embassy receives an incomplete packet?

3) Who does one get in touch with when a potential problem has been uncovered at this stage, or should one get in touch at all?

The petition has been approved, so let it continue through the process.

It might even be that the adjudicator who sent the RFE later learned or realized that it was a non-issue, and therefore approved the petition as should have been done before the RFE was sent.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Did you use the G-325 instead? I have seen people get RFEs for using it instead of the G-325A. Did you leave anything blank where it said to put 'none'? Whatever the problem was with the G-325A forms, it certainly was not because they were expired.

The OMB(Office of Management and Budget) expiration date only matters internally for the USCIS. That expiration date has nothing to do with whether or not it will be acceptable for you to use. The edition date is what matters. It can be found on the bottom left of the form pages.The accepted edition dates for the forms are listed on the site where the forms can be found and downloaded.

It was approved, so I think you are fine. If you are really that concerned about this, then take the correctly filled out and signed G-325A forms to the K-1 visa interview for your own peace of mind.
