My fiancee and i got married, two weeks ago. We got our marriage license last week. We try to get her a texas Drivers learning permit. When we went to the DMV. The lady said that she is not eligible on the basis that the I-94 must be valid for a year. Since her I-94 is valid for 90 days, we must wait for her to get a green card before she can even apply for license. Is that true?? or is there a way we can go around this?? We applied for her SSN, it went well.

I tried to get my wife a State ID card (instead of a Driver's License / Learners Permit) and I was told (in GA) that they would issue but it would ONLY be valid through the life of the I-94 (90-days) .. so we just waited for her AOS Green Card to come through ....

This may vary state-to-state but not sure that it will!

Good luck!

Every state has their own regulations regarding Id's and drivers licensees. You can see requirements for Texas here: http://www.txdps.state.tx.us/administratio...vingtotexas.htm

Does she have a driver's license from India? Texas allows one year driving with a license from India. If you get the EAD for her, she will be able to get the license with that as well (but maybe be good for only one year- the length of the EAD)

Yeah I've been wondering about the same thing. My Guatemalan fiancee is planning on getting a license in her home country (she doesn't have one yet, as does no one else in Guatemala, even though she drives....ahhh gotta love Guatemala) because then it's good for up to one year here. Is India part of the reciprocity program? If so then they can use their country's license for up to one year in TX. Keep me updated, I'm expecting her to arrive in August if all goes well.
