Simple I-864 Questions - Tax return copy or Transcript?

Hi guys,

I need your help with the following: Filling out the i864 and I am a bit confused. For evidence that goes with Affidavit of Support Forms. Some places I see they want :

1) Copy of fed tax return - plus w2's

or

2) Original Transcript from IRS.

I don't know which to send.(on the form it self 1st its says tax return copy then it mentions transcript).I have both, but no copy w2's for the return. I could try to get w2 copies but that would take some time (3 different jobs in that year). I want to send this off early next week. 1. Is the transcript by itself good or not?

Also 2. do they count unemployment benefits as income or just straight salary and wages? Income for last year was below poverty level, but current income is above 3. will they use current income or what was made last year?

I'm sorry if my post is confusing but this is exactly my state of mind right now confused! Thanks in advance for your help VJ you guys are the best.

1) a tax transcript is better than an entire tax return. It comes from the IRS so is proof you actually filed and is simplified for the CO.

2) No. You cannot use unemployment

NLR Thank you ...Thank you... Thank You!!! I thought no one was going to respond and its the 2nd time Ive posted this type of question.. and it was like crickets. Your answer makes sense because I got the NVC letter last night and it listed supporting docs..(in my head it was in order of importance or clout) and I noticed the transcript was listed above the tax return. I think I will send both still just without the w2's because I didnt want to pay for them or wait years to get them from IRS. Also happy its current income because that mean my info isnt needed, Thanks again. Have a Happy Sunday!

Don't send the tax return without the w2s. That is incomplete and will get you a checklist. Just send the tax return transcript. They prefer it anyhow. (less paperwork.)

Tax transcripts will work, you dont need anything else. Unemployment income does not count. JA looks at income from previous and current year, so be prepared to have a co-sponsor as back-up.

Thanks for responding. I thought about doing the i864a even though his (us citizen) current income is above the poverty line. Because I thought it might make a problem or we get rfe for sending something we didnt need. His last year salary alone does'nt make it but both our income for last year is around $55,000 and We filed married but separately. I did order transcripts for myself as well just in case, so do u think I should do I-846a? so they will get:

transcripts for both of us 3 years worth (for me only 2 because I only worked 2013 after I adjusted status)

pay stubs 6mths for both of us

job letters for both of us

Hopefully this is enough :/

You wont receive a request for further evidence (RFE) for providing more than you need. I would just be prepared just in case.

Do not include your income in an I-864a unless it will continue after you move. Only use the petitioner's income and any joint sponsors.

Yes you can get checklists for including too much information, especially if it's incorrect or not needed.

Hi NLR. I'm not moving, myself (permanent resident) and my husband(usc petitioner) both live and work here. He is filing cr2 for my daughter in Jamaica. So I guess your saying its not a good idea to include both our incomes... :/ Sigh who said this process was easy...

Yes you can include your income since it's US based. Should actually do an I-864a.
