We filed my husbands AOS last July and he had to go back home due to a family member's illness in Sept 2014. We have proof of the AP he was approved for and the money we paid for to get it expedited. We received notice on July 2, 20154 that his I-485 was denied because he left the country without AP. We got an INFOPASS appointment and all they told us was to filed a motion to reconsider, form I-290b with the $630 fee! His EAD expires on Sept. 1. We sent the MTR on Friday and it is due to arrive tomorrow morning. I'm very concerned the MTR won't be processed in time and my husband will have to quit his job. I don't understand why we would have to pay for a USCIS mistake?! Any advice??

Yikes, sounds like the system took a dump on you. That advanced parole business is scary, my wife got one and we went on a trip to bahamas, on the way back we ended up sitting in holding for an hour until they figured out what the heck the advanced parole was. We didn't go again, it wasn't worth the trouble. It does seem odd you would have to pay to fix their mistake, you could try a local senator or something like that. I think rushing to get the mtr done was your best bet for now, but I suggest taking action to get that money back if you have proof it was their mistake. Good luck.
