A.O.S. Please Help So I dont Get Another RFE

Well we have finally reached the next step. I had an RFE originally with the I-129, and do not want that again. I have all my forms in front of me and am starting the painfull process. So far I have one main question.....whenever they ask for family name, is that my wifes maiden name? which is on her passport, or do we now put her new last name since we are married? Iam filling out forms I-864, G-325A, and I-485. I think that is all the forms I will need. I downloaded them off the USCIS website. I-864 says its expired already 3/31/15, I-485 expires 6/30/15, and G-325A expired on 2/28/15. So I hope all these forms will be good even though two of them have expired dates on them. Thanks for all your help.......

We are happy to help, but first you have to show you have done your homework. You would want to apply for the combo EAD/AP card (i765 + i131) as well, so she can apply for a SSN and a driver's license sooner. It is 'free' if you submit the EAD/AP forms at the same time with the rest of the AOS forms.

Have you discussed with your wife whether to change her family name? You did not specify where the marriage was recorded, but assuming your marriage certificate is from Oregon and she wants her family name changed, her new name must have been listed on the marriage certificate.

You on a deadline glazierguy? How about waiting more than 2 hours for an answer? Not all of us are in front of our computers on Memorial Day... see, you didn't even say thanks to the person who answered you above and it's already been more than 10 hours since he answered you ;)

If your wife changed her last name to yours after you got married, then you use THAT last name in all your forms. Otherwise, use the last name she is using right now.

The forms aren't expired for you to use, it's an internal deadline that means the forms are due to be updated soon, but you can still use them just fine. And as panda said, file for I-765 & I-131 as well, they're both free when filed with the I-485, and it'll allow your wife to work or travel outside the country before she receives her temp green card.

Also is "NOA2" my I-197 notice of action approval notice for my I-129F ?

The NOA2 referred to here is the approval notice for your I-129F which is form I-797, not I-197.

AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

where do you see the I-765 is free???? if you go to the gov. site it says its 380.00

That fee is waived if you file it together with the I-485 :)

"Q5. How much does this card cost?

A5. If you submitted an application for adjustment of status on or after July 30, 2007 (or on or after August 18, 2007, for employment-based cases), you will pay only one fee to file Form I-485, Form I-765 and Form I-131. The fee for Form I-485 is $1,070, ($985 plus $85 biometric fee), and there is no separate fee for Forms I-765 and I-131 associated with a Form I-485. For those cases that were filed under the old fee structure, the costs for this card will equal the combined costs of filing Forms I-131 and I-765, which is a total of $740. I must be blind I dont see the free filing of the I131, i see the other one for work

I copied the relevant part from my previous post below, so you can see where it says about the I-131.
