You can apply for AOS that is adjustment of status. You should file all of the application(i-130, i-485, i-765, medical documents, financial support document and other documents) in one envelope with respective fees. You can get all of the information on USCIS website in Green Card through family/spouse portal. Good Luck

Thank you all the replies and kind help.

It was my understanding that I could file I-130 along with AOS(I-485) and EAD(I-765). Can i file all 3 simultaneously? Is it correct? Do i need to wait until I-485 and AOS is approved.

I have been in US for about 7 years now, first on F-1 and then H1-B. Do I still need to file medical documents while applying for AOS?

also, my husband is a student and works part time. I earn far more than him. would that be enough for financial supports?

Thank you in Advance,

For medical documents, find a certified doctors in your area through uscis website (there is a list of certified doctors in USA).

For financial supports as per my knowledge US citizen or green card holder could support you.

Hi all

I sent all the documents to USCIS and have a receipt number. I am currently on H1B - full time worker since 2010 and was on student visa (f1) before. Never been out of status.

However I sent I-130 along with AOS (I-485) and EAD (I-765). and USCIS returned my check along with I-765 stating this form is not required.

Any idea why?

I-765 for EAD and I-131 for AP are free for AOS applicants. You shouldn't have been trying to pay for it. I don't know why they returned the I-765 but you can send it again with the I-485 receipt.

Hey Guys, so i received a notice for evidence today in mail. I had my bio-metrics done. However, I received a letter in mail today, that the income showed my husband's documents (form I-864) is meeting requirement of 125% US poverty guide line. He is currently a student and pursuing part time service industry jobs. I work full time and have been in status since my arrival in 2008. Currently I hold H1B visa which is valid till 2016 September. Not sure what to do here. any guidance?
