My fiancé was here in the US visiting me from January 29 - April 27th. We filed for our K1 visa on February 3rd. We are unfortunately at TSC. I want him to come back and visit for a month... like in July. He really wants to come too but is afraid the immigration officer will think he is trying to live here and that would be considered fraud. I told him he worries too much... lol. Do y'all think it is ok for him to come visit again? Or is it better to wait until we get the K1 visa approval?

He can visit whenever with his current visa. Plenty of couples have done this without issues while their K1 is pending.

General rule is to spend more time outside of the US than in the US, so if he was just here for 90 days, then I would probably say stay outside the US 90 days before coming back-which would make it August. That does not mean at all that he would necessarily be refused to come for a month in July.

Since he can visit after time has passed on the VWP, he can always come back for a July visit. I would suggest preparing a bit however, because there's no point wasting a lot of money on a flight and time off from work to be turned away.

I petitioned my fiance to come to the US, however, when I visited my fiance in England while our I-129F was pending approval, I took with me a letter from my employer stating that they expected me back to work on XX/XX/XX date and that I was currently employed there. I also brought along bills with due dates. Even though there was NO reason for them to deny me entry, there was a pending government request, so we took precautions.

I would suggest the same for your fiance. If it is not too much trouble, have his employer draft a similar letter and sign it. This shows he is expected to return home. Have him bring a few things that show ties to his country that he MUST return for - rent bills, letter from employer, gatherings he is supposed to attend, etc...

That way, if he IS questioned, he can show proof he is returning home.

During our K1 process I visited about every twice on VWP about 3 months apart no problem. Only thing I had with me was a copy of the I-129F just in case. They never asked to see anything and they were okay with me visiting my fiance.

Hang on, it might go faster! :)

In case you really want him to come, he should call the U.S. Embassy in Brussels to be sure he could enter the country.

or maybe you can go see him, Belgium is really nice during these warmer months.
