Hi all,

I was really excited when I opened the envelope this morning and there was my green card !!

On closer inspection though, they have got the month of my birth wrong. It should be 05 and they have put 06 so it is clearly a clerical error. Does anyone know what I should do to have this fixed, and whether the card is valid now that it has an error. The USCIS info line told me I could submit a whole new AOS which I think is ridiculous !!!! I wanted to get my SS number but my husband thinks I wont be able to if I use that card as the birth date is incorrect. Im so disappointed and any help anyone could give would be greatly appreciated.

Would suggest you do a search on green card errors as I've read previous experiences of other VJers with errors on their green cards. I think you don't need to pay additional fee if it is their error. But, I could be wrong so it would be better for you to do a search.

If your card was issued with incorrect data due to USCIS administrative error, you must mail a new I-90 application using Application Reason "d" My card was issued with incorrect information because of a USCIS administrative error, and any supporting documentation, to the USCIS Service Center/National Benefits Center(NBC) that processed the application/form from which the incorrect card was created. Check the envelope that your I-551 permanent resident card came in to find the mailing address of the Service Center/NBC that mailed you the card. The Service Center/NBC address can also be found on the I-797 "Notice of Action" issued for the application from which the incorrect card was created. In addition to the new I-90 application, applicants are required to send the original I-551 card containing incorrect information, plus the supporting documentation for the requested correction. A replacement application based on a USCIS administrative error must also include an explanation.

There is no fee required. Total filing fee - $0.

thanks so much for all the info. Did you wait a long time for your new card, and were you able to work whilst your incorrect card was returned to the service center?

I assume that you didn't file for an EAD then, cause if so you'd already be working I'd guess and wouldn't need the greencard to be eligible to work. You could always go to an infopass appointment and see if you can get your passport stamped, that will show proof of permanent residency.

I did file for EAD and AP at the same time as AOS, but my case was processed very quickly (7 weeks in total) and having received the green card, assume that EAD and AP will not be processed further? I am waiting for my attorney to call me back but I too think an infopass appt might be a good idea, especially as you say, to get my passport stamped.

O ok, yeah they will abandon your EAD and AP applications. I only asked about EAD because obviously sending the greencard back wouldn't affect you working if you've already had your EAD and been working with it. I would be sure to find out about the stamp (although there could be other ways to avoid losing out on opportunities to work that I'm not sure about) because knowing the USCIS it will take them awhile to get you back a new, correct card.

My card was also issued incorrectly by the CA Service Centre. They spelled my name wrong.

I was told by USCIS to send the following:

• Form I-90

• the green card in original mailer

• photocopy of my CR-1 immigrant visa issued in my name, with admission stamp

• photocopy of the photo page of my passport

to the following address:

CA Service center

Attn: I-90 b or d

PO Box 10090

Laguna Niguel CA 92607-1990

I also included a cover letter explaining the error. I sent this in the first week of December 06 and unfortunately have still not received my new green card. I have tried to track it twice but no one can tell me anything except that I have to wait - I can ask again after 6 months!

I was still able to get a social security number with the error, but they then assigned me 2 names, whether they can do that with a birth date I don't know. I would recommend you bring some additional proof of your correct date of birth - your passport and maybe your original birth certificate as well.

I scheduled an Infopass interview to find out where the green card was - which they couldn't tell me - but they did give me a stamp in my passport valid for 60 days that actually says employment authorised on it. I will have to go back and get another stamp if it runs out before the green card arrives.

this is a massive help - thank you so much for the info. I have scheduled an infopass which is ten days from now so hopefully I will get them to stamp my passport and then send the card back for replacement. I will include a copy of my K-1 visa, passport photo page, green card as mailed, and I-90. I will also include a covering letter pointing out THEIR error. I guess as long as the passport stamp allows me to work and leave the country if I need to, then I wont worry too much. Thanks again.

My wife received her green card around Feb 20th, 2008 and it had her birthdate incorrect. USCIS told us the same, to send the original greencard, proof of her birthdate, and passport and visa copies. However, on some form i read it said to retain your green card and it'd be used at a meeting at a local office. I didn't read that until after we sent the card though. The worst part is that it's been 3 months and we still haven't received a confirmation receipt or case number from them. According to UPS the package was delivered and signed for.

Today i called them and they said they can't track it because it's still within the 6 month processing time frame. They also said that with this particular type of case, there is no receipt or case number assigned. The DMV wouldn't accept her green card copy as valid, but we showed other documents so that wasn't a problem. She's working as a cashier in a grocery store for now and they accepted her EAD as valid. She was also able to register for classes at a technical college but only as a dependent of spouse. How can i prove to the airport that she's a resident though?
