so should i not file for EI using the online system then? and just call that number to have them mail me the forms?

July 10th 2014 - NOA2

NVC

July 17th 2014 - Case shipped to NVC

July 30th 2014 - Case received by NVC

August 13th 2014 - Case number and IIN received by email

August 13th 2014 - DS-261 Form Completed

August 14th 2014 - AOS Fees Invoiced and Paid

September 17th 2014 - IV Fees Invoiced and Paid

September 19th 2014 - DS260 Completed

October 6th 2014 - AOS and IV Packages Received

November 28th 2014 - AOS and IV Checklist (4 items in total. 3 for documents they lost. Called on December 9 and a rep said no checklist for IV....go figure)

December 8th 2014 - Checklist scan date.

December 30th 2014 - Case Compl........NOT. So after not having an interview date yet, I called again on Jan 30th and apparently its in final review with a supervisor.

February 6th 2015 - Case Complete: Supervisor called from NVC to confirm everything has been completed now.

March 27 2015 - Interview Date

March 27 2015 - Approved!

She submitted the termination via our HR system and our payroll back end team generates the actual ROE. Lets see what they do, worse comes to worse I can get the ROE amended if EI wants anything specifc

We dont normally use the comment block but did they put anything in Block 18 indicating to follow spouse? Maybe visa submission for documentation is enough?

Yes you can use the online system.

You won't have issues because you're CR1.

You do end up having to fax them a form (that they will mail you so put your US address on the online form) and proof of your green card (endorsed visa works.)

My ROE simply said "quit."

Really it doesn't need to say relocate for spouse. You write that on the online EI when you submit that.

my last day is today and my manager said the only option is to select "quit due to relocation/moving". I guess that is the right one to select and we can specify with EI why if they ask

That's not accurate. There is an option to write in the reason. I wrote mine out to say Moving to be with new spouse or something like that. The spouse part was important.

in the near future i will be approaching this and knowing what a nightmare our HR dept is, I just dread it.

any caveats I should know now to circumvent obstacles?

I teach.. l should have my interview in late june, early july so I will be leaving sometime over the summer. and since i'm under contract I will have to resign, and once I do that the pension board is notified.

i'm guessing resigning and retiring are 2 different things. are they in ei minds?

i sure am hoping so....after contributing to ei since 16 and not having had to claim, I sure would like a slice of the pie.

I'm sorry this is all very confusing to me haha, so my fiance would be able to apply for unemployment when she leaves her job and comes here until she is able to work? If I'm totally off and this sounds like a dumb question sorry in advance!

Kind of but she cannot collect employment insurance until she is able to work. That is how EI works. You need to be willing and able to work and a K1 cannot do that until they get their EAD. Just because you are willing and able doesn't mean you'll get a job right away.

You should be fine. The only people I've seen with issues are K1 because they can't work until they get their EAD.

Hi people,

I filed the unemployment paper after I quit my job to move to the US on a K1 visa. I got a letter back saying i'm not eligible for it because i'm leaving outside Canada so not available for working.

I know I read somewhere on the forum it happened to people and there was ways to fight the decision but I can't find the topic about it.

Did it happened to someone here?

What are the next steps?

Do I still have a chance of having unemployment$$?

Are you talking about the scary letter you get in the mail? That's automated from the computer system they use. You haven't been denied. If you need to, call someone at the hotline and leave a message and they'll get back to you. Essientially you file for unemployment, but they can't give you any until you have your US Employment Authorization Card in hand. You then Fax in a photocopy of that and you will then magically begin getting your unemployment. Note that a) you MUST file for this card as it's not just given to you and b) you MUST complete the Canadian unemployment stuff a few days after you leave work just like you are at home, and then your case is put on hold for a few months until you have the card in hand.

NLR gave a perfect explanation above - ensure that you are reading comments based on the type of VISA you're doing.

Someone who is a CR1 (already married) has the authorization to work immediately when they move vs your Fiancée who is a K1 and is NOT eligible to work in the US until she has EAD (employment authorization) which is a few months after applying for AOS (post wedding)

She as the Canadian needs to educate herself on whether she is eligible for Canadian Unemployment. I would recommend that she either start an account on VJ as well or share with you so she can ask Canadian specific questions too!

Depending on whether she is employed now and has been paying into EI for a certain period in Canada - she may or may not be eligible eventually anyway.

The reality is that for K1 especially - there are a few months where no money is coming in once you cross the border and you're not eligible to work yet in the US either....be prepared, save $$$ now.
