Filing Tax returns

Ha ha ha. I neither spoke with a CPA, nor did I take accounting classes and this is what I did:

When I applied for my wife, I sent tax statements where I files as single. I think the primary purpose is to see of the petitioner is law abiding tax filing citizen rather to validate whether it was filed as single or joint. So if yoir brother applied as single, he can continue doing that and in case asked your sister in law can state that your brother stated that he couldn't file jointly due to lack of information.

I may not have done this in the most accurate manner but the job was done without any questions on tax return. I am having a feeling your brothers case is pretty straight forward as well and if it is, why complicate with these?

There is a lot of wrong with that answer. First of all how can he be a law abiding tax filing citizen, if he is filing single when he is married . He can file married separated without the ss number of spouse

Again bad advice unless you met filing married filing separate

When I applied for my wife my past tax years was single but if they want this year I will be filing married.

Also usually there are bigger tax breaks for filing married jointly

A married person can file married but separated then amend the tax return to married jointly later

Dude.. you should NEVER file single if you are married. That's the opposite of law abiding. True, one could get away because the IRS cannot verify every single return, but an eagle-eyed CO at the embassy can raise a stink, and justifiably so.

Not wanting to complicate does not mean taking an unlawful route.

As noted above, yours is bad advice.

Very true !!

I wouldn't sign and submit a paper saying "I am telling the truth" where it simply is not. If you are filing as "Single" but in reality you are not, how does that work?

Your papers may have fallen through the cracks or you simply got lucky.

You gave them the wrong information. Like I said, my taxes are filed the way my household legally needs to file. So lol...I hope you don't get caught... But you said you NO your household, I don't. Hopefully, it's correct and even though your married... To the op please seek advice from a professional for your brother.... Good luck
