Adjusting status for mother while I130 pending.

HI guys

I was searching a topic and i found your forum and hope someone can help me. I am a Naturalized US citizen and i have filed I130 for my mother which is still pending. My mum is visiting me here can i just file i485 while she is here right now even though I130 is pending ?

If Yes, Do i just fill up the I485 form and get her medical check done and send it in ? Or is there another procedure to do this ?

Your help would be highly appreciated.

That is considered immigration fraud, just wait for I-130 to process.

Sorry mate that is not considered immigration fraud please check your facts before replying. Even the USCIS website says if the beneficiary in the US legally they can adjust the status here for immediate relatives.

Visa fraud depends on what was said at the time of entry. No one knows, so no one should be shouting fraud here.

US law states that USCIS can not deny an adjustment of an IR of a USC for preconceived intent to immigrate as long as the person did not lie.

You don't have to like the law. It exist regardless of anyone's opinion.
