No matter what age an I 130 must be filed with accompanying

docs to show how the eligibility falls in place, copy of your

birth-cert, hers & marriage cert showing you marry her dad

hopefully his name shows on her birth-cert

thanks for your response, well I married her mom, she is 12........ and yes her dad name on her birthpaper.

my wife is here from last year with our son which came on a CRBA

How old was the child when you married the parent ?

If she's under 21 Years of age (I think it's 21), you just file a i-130 petition...I filed one 13-months ago for my step son. HIs interview is this week...

congrats and thanks
