I don't know if this is the right section of the board‎. Please move it if need be

‎My concern is I'm currently out of status but, I have mailed my AOS forms in. It's time for my husband to file taxs. Will there be an issue with me being out of status? Will the IRS report me to DHS? Should we Hold off on filing?

If your tax return needs to be filed, it should be filed.. regardless of status. It's not IRS' job to report people to DHS.

Moreover, down to the road to GC\Citizenship, applicants are asked to submit proof of compliance with US laws, and filing tax returns (if and when req'd) is one of them.

Government agencies don't talk to each other much. If you don't have a SSN or an ITIN, your husband can not file jointly with you. He would have to choose Married Filing Separately. If you earned no money in the US, you don't have to file a return for yourself.

Okay, thank god. Because I'm still worried about health insurance. We had to apply our son, and they asked for my social and I got a letter back stating, I'm an illegal alien (I'm on K1 visa, i thought I was aloud to stay here while I wait for AOS?; anyway!) and, I'm basically not entitled to any health benefit packages so, whatever... That's besides the point, a little paranoid with them reporting me so, I thought the IRS would do the same if they found out, that I'm "Illegal".

I'll tell him he can file. I didn't work obviously, I am a stay at home mom. We were going to put me down as a dependent; if it's allowed. I know back home (Canada) it is.
