Filing N-400 without waiting for I-751 approval?

Hi all,

I've read in the forum that one can apply for naturalization without necessarily removing conditions. Unfortunately, I couldn't find that post anymore.

Anyways, a friend of mine filed her I-751 last August 25, 2006. Until now, no fingerprinting yet. She have made numerous calls to Nebraska and they just tell her that they are still processing July receipts. I filed mine last October and I've had my fingerprinting already. This October is the 3rd anniversary of her being a permanent resident. Can she file for N-400 without waiting for the approval of her I-751? She would surely like to avoid the fee increase if possible.

05/02/2007 Driver's License - Passed Road Test!

05/27/2008 Lifting of Conditions sent (TSC > VSC)

06/03/2008 Check Cleared

07/08/2008 INFOPASS (I-551 stamp)

07/08/2008 Driver's License renewed

04/20/2009 Lifting of Conditions approved

04/28/2009 Card received in the mail

I am not so sure. You need to attache a copy of your GC to N-400. What do you do if your conditional GC is expired?

I am not so sure. You need to attache a copy of your GC to N-400. What do you do if your conditional GC is expired?

I am sure. It is a well-documented event from back in the day when I-751 regularly took 18 months to be adjudicated. This was a common way to force adjudication of the I-751 in fact, becasue they have to pull your file up and complete that as a part of your natz application.

You can search the group alt.us.visa.marriage-based for plenty of examples.

If a card is expired, then what? If the I-751 has been properly filed, your status is extended until they adjudicate. Just because the card is expired doesn't necessarily mean that you are no longer a PR.

I know one person who posts who went all they way through the naturalization process and never once had a Green Card. He was still a PR, they just never could get the card production right.

Kim came to America under K-1 in May 2005, got her CPR in March 2006. Plan to file her 10yrs card sometimes in Jan next year. Question: when will she be able to file for her N-400? Is it 3 years or 5 years living in America continuously? Thanks....

its 3 years after becoming a CPR, if you are married to a USC... so sometime in the beginning of 2009, she would be able to file the N-400

Chuck, please see the pinned thread at the top of the Citizenship Forum; it spells it out fairly clearly (use a date calculator!).
