Hello,

i'm in the process to get a Visa, I-130 (filed in 09/14), i know i need a waiver for the unlawful stay in the states.

I was deported for overstaying my B2, but we filed for the proper visa, i'm just waiting.

We try to make the best out of it, so my husband visits me when ever he can.

I miss my family (his side) in the states, is there any way i could file a waiver for the ban, that i got, and get a short-visit visa to see them?

My mother-in-law is sick and i wish there would be a way to visit her before it's too late.

Even when there is just a very slim chance to get a visa/waiver approved (i guess the chance is slim because i abused my first B2 Visa already), i like at least "try" it.

No, you'll have to file your I601 and I212 waivers and wait for them to be approved and then for the embassy to issue your visa. You can try for an expedite once you file the waivers. You'll need evidence of the situation.

The I601 is for the overstay and the I212 is for the deportation. Each is $585 to file

i try to get information what need to be done. what i need to ask and if its even possible. no i didn't contact here yet for that issue.

I hardly think they will furnish U a D3 visa reasons being,its

not your mom, immigrant intent , deportation, & previous

overstay...but you can use that info to try & expedite it

as soon as it gets to NVC when U send payments in you

add the requests, if not given , U can again try when waivers

are sent out to Nebraska.

D3 waivers fly when the CO recommends it, although if

one is prepared & handed in with B2 request , they go ahead

and send it to AAO who tends to turn it down because CO did

not sanction it & they wont except for on dying or death while

one is going thru the process

NVC and USCIS are two different sections of the government. If you decide to try and expedite, you will have to request that at every stage of the process. An NVC expedite does not carry over to USCIS for the waiver adjudication. NVC expedites are fairly easy but USCIS expedites are rare. Make sure to provide hard evidence of your reason for expedite.
