Hello,

My fiancee has a 6 yr old son and we were wondering what we have to do because he doesn't have a passport yet but he wont be traveling with his mom to the states but he will be coming out later, maybe 1 to 2 years later. I know we have to list him on the I-129 and the G-325 but will we need to provide a passport at the time of her interview or can we just wait on that? The reason I am asking is that i talked to an attorney here in Arizona and she said to make copies of all his pages and include it in the I-129 packet, but he doesn't have a passport and his mom cant get him one until after she gets back to her home country. Thanks

Hi, i have a son too but when my fiance submitted our I-129F packet he didn't include my son's passport. He only listed my son's name on the I-129F. I applied his passport after we got approved by USCIS. You only need a copy of his passport in the medical and embassy during the interview. By the way, I was interviewed in USEM Manila. I am not sure about others. I hope this info helps. :)

Copies of all passport pages are required by the petitioner, not the beneficiary. You must include the dependent on the original I129f form if you plan on bringing them during the first year.In my opinion, it will be a big mistake if you wait longer than a year. It may take several years if you wait longer than a Year.the dependant will need the passport at the time of the intervieW if they will follow within a year. We just went through this. My recommendations are,if you love your fiancee, and there child is as important to you as your own,make sure to include them and get them to the states within the time frame,or you may be looking at years and regret. Get the passport,include them in the interview,and stay within the time restraints.I have friends that left there children out,for reasons I understand. If you are giving up your life as you know it, to move across the world for someone you believe i?? You don't want a child.to get hurt,or stuck. Until your fiancee arrives, they will.have no idea. It's understandable.for 20 or 25 us dollars, get the passppassport and include them in the interview. You will then have 1 year.assure your new bride,and give your love love to support her child and you won't regret a thing later. :-)

No, he doesn't need to attend the interview.

Not needed.......do need a new attorney though !!

If it's more than one year after the mother immigrates to the US, then you as the USC spouse would have to file a I-130 to petition for him to obtain a visa to travel to the US The wait is about a year after filing. If the mother wishes to do that, then if she only has her GC, then there is a 5 year wait. If she first obtains her US citizenship, then its a year wait. Best to bring him here on a K-2, within one year of the expiration date on the mother's K-1 visa.

ok thanks for the info. She will get him a passport when she gets back to her home country of Kenya. She is in Qatar right now working. One more question I was previously married and my divorce was final on 3rd of November 2014. I was divorced in Nebraska and I know the law says and the decree says I have to wait 6 months but I don't live in Nebraska anymore, I am a resident of Arizona now and have been since April of 2014. The question is do I have to wait the 6 months to submit the petition for my fiancée or can I do it now?

If AZ has no waiting period, then you are good to go.
