I am running into a difficult issue and I'm not sure how to proceed from here...

My fiancé and I filed a 129-F petition about 7 months ago and we recently received a notice that our process was stopped because of a discrepancy between the name she put on the application and her passport. In her culture it is common to have four names, though in practice they only use the first three. While filing the application she only wrote her first three names, but her passport has all four. We overlooked this aspect while preparing all of the other documents to file.

The notice is asking for documentation showing a name change or proof that it is the same person, though both her birth certificate and her passport have four names and she does not have any other official documents with only the first three. The only other documentation she has are her school records, the one from 8th grade which shows three names and her 12th grade records which show all four. Both have pictures on them but they are 4 years apart and she is wearing a veil in both of them so it may be difficult to verify from the pictures, and clearly neither are "official" documents.

Our plan so far is to send a affidavit explaining the situation and swearing both are the same, stamped by a lawyer, and send both of the school records, along with her birth certificate. Besides this does anyone have any advice?

The name on the passport should be the official name.....if not, then a new passport is needed.

What if she cannot get a new passport? She cannot change her name, her family would not allow it. Does that mean we have to start all over again or is it possible to send a new application with the full name on it?

Just send all documents you have with the 4 names and explain that you forgot write the 4 names.

Explain that 3 names is a mistake, that the correct name is the name on the passport and on her birthcertificate.

Send a sworn statment from a lawyer explaining that.

Explain that the 3 names isnt mean a name changes, that mean that was a mistake writing the name.

You dont need show that her name has 3 names you need prove that the passport is the correct, so use her birth certificate, and send with the rfe a new g-325A form fill out with her 4 names.
