Hi guys i just wanna ask about my fiancè's previous marriage.. so here's the story.

My fiance got married in Singapore on 2007, on 2008 she lost communication with her hubby. In short, they've been separated from 2008 till now. But their marriage which took place in Singapore wasnt registered in Philippines. So in short, the marriage is invalid. And in my petition, she didnt indicated about the previous marriage since she can provide a Certificate of No Marriage (CENOMAR) from the Philippines.

Question is, would that be a problem or will the marriage be will be traced?

Thanks in advance.

Technically, she was married though she did not registered in the Philippines. Keep in mind, the US government recognized all forms of marriage even if it is a religious one. She has to deal with USCIS for immigration and in front of UCSIS, she was married. Did she get divorced?

The US recognizes marriages celebrated in Singapore, so for all intents and purposes she is still married. She must get a divorce before you can apply for her K-1 visa. Her best bet is to contact the Singapore consulate in the Phils and get a divorce.

Good luck!

If you already sent the petition, I am afraid your petition is going to get denied because she is still married and one of requirement of I-129F that both of you are legally free to marry.

If she never divorced or annulled, then she is still married and not eligible for K-1, regardless if the marriage wasn't reported to PH.

She will need to take care of this before she can proceed with K-1.

You should hope for that! I'd contact the SG consulate in the Phils and ask about getting a copy of the divorce decree. Without it your K-1 petition is void.

You will have to have a divorce decree of some kind from Singapore before you could ever file a K-1.

USCIS has this stuff, a turned down K-1 would just make the next one more difficult.

Hope you can find the decree, releasing you, from your previous marriage.

She can cancel marriage registration in Singapore by telling there is no contact with her Spouse foe more than 2 years. Plus she will get free legal consultancy. It is easy to go step by step and legally.
