Today we received an RFI in the mail, stating : "From the evidence, it is not clear where the petitioner and beneficiary will wed. Therefore, please submit a statement indicating in which state the petitioner and beneficiary intend to marry.".

In the original K-1F packet we stated that we intend to relocate to Spokane Washington and have checked the marriage license requirements for Spokane county. No where do I recall being asked in what state the marriage will take place, and it seems to me the answer had already been provided. We currently live together in Argentina and have no U.S. address, if that is relevant.

Is this normal, unusual, or just trying to make life difficult?

As far as I understand you need to show that you are relocating in the US (real state agent, house search, a job offer, etc) Sometimes the US Citizen come back before to settle down and bring the spouse or fiance because those are visas to reunite the families... so if I'm not mistaken you didn't show you are coming back to the US with solid proof

I forgot to add, is necessary you prove you can and will support your wife or fiance in the US, there is a minimum depending on the size of the household and if you cannot provide the support yourself, you need a cosponsor that can, plus your tax receipts (if I remember accurately is three years of taxes in the US)

Any chance you marked the sex of one of you incorrectly, and they think you're a same-sex couple? In that case you could only be married in certain states.

Pretty strange otherwise. But there's not much you can do other than draft a letter stating what they ask and signed by both of you.

I'm the USC petitioner.

No accidental mismarkings as to gender, and immediately after the above-mentioned statements about getting married in Spokane Washington, we also stated we plan on buying a house within 1-2 years of our arrival where we will spend the rest of our lives together. Not too ambiguous, no?

We've already drafted and signed a letter, which we will FedEx in the morning.

Check out the letter of intent on the example forms in the guides. Maybe you can modify that to suit your needs in response to the RFE.

I have heard of others getting RFE's for things they are most certain they have already proved. It could be an error on their part, perhaps a document has been lost etc etc. Just respond to the RFE as best you can and hope for the best.

Good luck with the rest of your journey!
