You need to a bare minimum file taxes for the last 3-7 years. I guarantee you the the gov't will keep your tax return in perpetuity until you do so, not to mention it is a possibility that your tax returns for the last 3 years are asked for at the embassy. Tell them that they will have no responsibility. There really isn't any teeth to the affadavit of support. I wouldn't even stress out about that part.

You've been at your job for 4 months, and it will probably be another 6 months or more before your fiancee goes for interview. By then you'll have almost a full year of work behind you. You shouldn't need a co-sponsor. Your income exceeds the poverty guidelines. Your 2014 tax transcript, a history of pay stubs, and a letter from your employer verifying your employment should be sufficient at the time of interview.

I had moved back to the US and only been employed a year at the time my then fiance had his K-1 interview and we were fine without a co-sponsor.

Hi OP, my fiance used to live here in Guatemala with me at the time we filed for our K-1, she moved back to the US one month later and she has never filed taxes, she was under the threshold. Let me explain what happened during my interview.

I had done a lot of research on this matter and asked her to send me a letter addressed to whom it may concern, the reason as to why she hasn't filed taxes yet, I asked her for a letter of employment and her paystubs.

At the interview, the CO told me everything looked good, but because she hadn't filed taxes I needed to come back with a co-sponsor. (I was like, man this sucks) but then, I decided to speak up and I told her "Okay, however, the reason as why she hasn't filed taxes is stated on this letter, we also reaserched and found out that we needed to show you a letter of employment and I have her bank statements" she said "yea, but still, ya'll need a co-sponsor" I was about to accept her answer but right when I was going to say okay and go back home, she interrupted me and said "wait, you mentioned you had a letter of employment, give it to me and let me speak with my boss" She took the letter, asked me to wait a couple of minutes and then she came back and told me I was right and that I was approved.

I think you should be fine.

you could also look at it like this. The consular officer did not know her job that well or never had a situation like this before and was going to deny. Then decided to talk to her boss to see if she should deny or not and was told that it was ok to approve with a letter of employment.

I don't think I got away with it because she hasn't filed yet. There's several threads about this on VJ and some folks have had the same experience, that's where I took the information as to what I should have with me at the interview.

That's what I thought, she wasn't too sure at the process when someone hasn't filed taxes but does have the rest of the required information. Either way, the good thing is that it worked out.

The important thing here I think, is to remember that if you feel like you need to speak up for yourself and your specific situation during an interview, don't be afraid to do it. If I hadn't done so, I would've had to schedule a different interview AND spoke to my in-laws to be my co-sponsors which we didn't want to, even though they had said it wasn't a problem. (Way before the interview, we explained the situation clearly and they said to just ask them if we needed their help).

Savings can be counted if you don't meet the income requirement; however, the amount of savings/assets required is far and above the amount the OP has, something close to $90k. So no savings are NOT counted in her case. It is for those who have NO income or are below the requirement. If the OP were self-employed living abroad and she makes more than $400 she has to file. Yes that is right. I suggest you learn to read and think.

I suggest you stop assuming your last post you assume the op was not going to file taxes now you bring up self employed assuming if the op was he did not pay taxes. I am sure the op would of pay taxes if require.Think before assuming something
