Hello!

I just got my RFE letter today and I have some questions on it. any advice would be helpful. The RFE is requesting more evidence of meeting beneficiary in person preceding the filing of the petition. I do not have copies of my airline tickets, but I did send an Itinerary and boarding passes from my return trip as well as a baggsge calim sticker with the corresponding flight number and date including year. I sent 8 photos of my fiance and I, which i wrote the date and location in back of. I aslo sent a copy of the hotel registry receipt showing that we stayed in the same room at the hotel on the same dates. These are in Portuguese and English, I am going to resend them as well as fully transalated copies. I did not send copies of my passport and stamped pages but I intend to do so with the RFE. I am not sure if the photos need to be resent due to the fact that it seems they want the dates to be film dated. I am not quite sure what they mean by this but I am guessing it has to have a digital date stamped on them. Las of all I am going back to Brasil in 2 weeks and I am wondering if I should wait and send proof of that trip as well, even though the request is asking for proof preceding the filing of the petition. Oh one last thing my request did not ask for the benificiary's birth certificate, which I did not send. I noticed on some other threads some people were asked for this. I never reas anywhere that it was required and I am wondering whether to obtain it for fear of being sent another RFE requesting it. Thnaks for amy input.

Hi,

I'm not an expert at this but I have gone through the process you're going through now. If your pictures don't have the date imprinted you can download a free program that will do it for you, http://snipclik.com/. The program will use the time stamp in the pictures as the date. If you have the pictures in digital format you're set (if not then I'm not sure how you can do it.) Finally print the pictures at Walgreens or Costco or wherever they take digital prints. I believe any pictures up to 2 years old will be ok.

Sorry for th RFE, send the evidence they ask for, dont worry about the birth certificate. He/she should obtain one if she doesnt already have it and send you a photocopy, in case they ask for it but it shouldnt be a prob cos its usually not needed until the consulate stage.

Do you not have passport stamps for your visit?

I do have passport stamps for my VISA, that's about the only thing I did not send in. The request for evidence is very vague, does not realy specify any one thing.I am going to resend everything I sent the first time around plus photcopies of the passport. This includes and itinerary for my trip from yahoo travel. 2 boarding pass stubs from my return trip with my name and dates on them. A corresponding baggage calim ticket with date including year. Credit card statements and receipts from my hotel stay.( This time I am having the Portuguese ones translated.) Copies of both my fiance and my hotel registry sheets (transalated) and the fotographs of us together with handwritten dates location and names on back. I also have a hotel receipt with the name, date and location of hotel, made out to my fiance under her name. This all seems like pretty solid eveidence to me. Am I missing something?

Thanks that is what I intend to do. I am just a bit frustrated because the request is so vague, I've already sent a lot of the things on the request. I am thinking it was just the fact that i did not have the receipts transalated.

Adding the additional stuff you already said sounds good, if you dont mind the extra wait I would go ahead and wait and get more evidence from next trip. Not sure as you said if they want only proof preceeding the application, but the extra can never hurt.

Why would they care if a pic has a time stamp. They are probably one of the easiest things to fake on a pic. It seems that they wouldn't care since they are not reliable at all. There are even crime documentaries on Discovery Channel that show how some criminals try to create an alibi by manipulating the time stamp. Are the people at the service centers that out of the technological times?

Remember photos are secondary evidence and do not carry the same weight as primary evidence. Your passport stmp is the most importnt new information you can send it.

Did you highlight the dates on the evidence you did send it? Make notations on it o the ajudicator can make sense of everything they are looking at? Sometmes it looks like it makes sense to us, but from a stranger's point of view, it does not tell a complete story.

What did you write in your Question 18 about how you met? Did you offer evidence from that , if it was a meeting in person?

I really think that the passport stamp will be enough to add strong primary evidence.

Good luck getting a quick resolution once you have sent ths in!

I agree 100% with what you just stated, the whole tiem stamp thing seems absurd but I do have the EXIF files for all the pictures with the date and will print them with them time stamp.

No I did not highlight the dates or make notations. Both were probably huge mistakes on my part. I will make sure I do both this time around. I did offer evidence of meeting in person but I gues you are correct in stating that it made sense to me but might not have been clear to the person handling my case. I agree with you that the extra cannot hurt. However I am leaning toward just sending copies of my airline tickets and captions indicating I am going back in 9 days and not waiting to burn the almost 4 weeks it will take for the trip. It seems pretty clear that they want evidence prior to the 129F being sent, so I don't think waiting makes sense at this point. Thanks for the suggestion though, it is appreciated.

Timeline

The most important evidence was what you did not send, that was the entrance and exit stamps on your visa. Send that and a couple more pics of yourself and your fiance and write when and where the picture was taken on the back, will suffice. You need to make sure your copies of the visa are prominent....all the other stuff that you are talking about collecting isn't that important.

Patience is required for this process.
