Hi Guys,

I'm a F-1 student who is on my OPT and I'm filing I-765 with i485 and i130 AOS application.

My question is that since I have the EAD of OPT, which is going to expire on May, 2015, when now I'm filing I-765 under a new category - c9, under “I am applying for” on the I-765 form, should I check :(1) Permission to accept employment. or (2)Renewal of my permission to accept employment ?

I read the i765 instruction many times but still not sure about this.~~==

Thank you in advance for your help!

Thank you CdnRN ! I think it's the first one, too. Because I'm applying it under a brand new category.

Does anybody have different opinion?

Thank you all in advance!

you know that you don't *have* to file the i765 if you're already on F1 OPT right? i never filed the i765 since i was already on F1 OPT and was half a year away from its expiry when i filed my i130/i485. anyhow, if you do want to file the i765, i'd check the first box just cos it's a new category like you said.

I'm half a year away from opt expiry now, too. But I want to file i765 just in case. Plus it's been almost 90 days since my last job so...yo know.

I agree with you. I'll go with the first box.

Thank you very much! :)
