I just got my RFE letter and it says we don't meet the 125 % of the poverty guideline...

it is not true because we are way above it...

I am confused and getting in a panic mode here.

Has it happened to somebody ? Maybe they are just wanting something else ? We sent the I-864 along with the 2005 taxes and pay stubs. Maybe they are wanting employer letter or something ? heeeeeeeeelpppppp :cry:

What did the RFE specifically say? Who knows with them, they like to make our lives more confusing, so even if you are over the level maybe they just want more evidence. Did you send in every single piece of evidence you could (W-2s, letters, paystubs, etc etc) or only some of it?

Hi, don't panic, we got an RFE for the same thing. The letter seems to be very general and has loads of different options and I think you just have to pick which one applies to you... If I were you, I would just send more evidence proving that you earn over the poverty limit, this seemed to work for us. Ed didn't even have tax returns or W-2s, so we had to think of other ways to prove it. We sent

- Letter from employer (University of Southern California) stating how much he earns, how long he has been employed, how long he will be employed for

- About a years worth of bank statements (copies)

- A few pay stubs which we found in the pile of rubbish in the corner of our room

Hmm I think that was it actually (I really should make copies of whatever I send to USCIS...)

Anyway, don't worry, just concentrate on getting some more stuff together and you;'ll be fine. Good luck!

Based on the documents submitted with form I-864 affidavit of suport and the information provided on form I-864, the petitioner's or substitute sponsor's income for the last tax year and /or current income does not meet

125 % of the poverty line for the household size calculated on form I-864. Submit proof that the petitioner's household income meets or exceeds 125 % of the federal poverty line for the household size provided on form I-864.

Yeah, I can see why they sent you an RFE. Send them exactly what they are asking for on your RFE and you should be fine. The I-864 asks for 3 years of tax returns, 6 months of paystubs, an employer letter. I know it says you "may" send those things, but we also didn't send them every single thing and got an RFE so I think that may is really a must. I'd read of the I864 and be sure you are sending them every piece of evidence you possibly can and, assuming they are above the 125% level (which you say they are), then you should be ok.

I will try to don't panic and send them the employer letter.. maybe we should file the 2006 tax return and send it instead of the 2005 too...

He also 'couldn't find' his W-2s (useless men) so we just had to improvise. WE didn't get an RFE for the RFE and I have my interview at the beginning of March, so I think it's ok :)

Should be ok, you obviously can't send what you don't have :) I only advised that to them since that is what the I-864 says to send, so in my opinion it's best to send everything you can (especially to prove their case of being over 125%). I'd just be sure you note that you didn't file in 2003 and get as much of everything that you can :)

To be honest it seems like they almost always send an RFE for the I-864 (mainly because they're incompetent). In the first instance we just sent in Ed's contracts and one pay stub (Hmmm I wonder why we got an a RFE...), so then we sent in 2 of his contracts, and everything else I said in my post above. It isn't ideal not having tax returns, but if you have a reason (we also included a letter explaining why he had no tax returns) they can't expect you to conjure them out from thin air!
