Hello Everyone.

We are planning to file for a IR-1 visa soon. I have couple of questions as below.

I am going to India to meet my fiancee and be with her for sometime for about 6 to 8 weeks. Can I file the petition and post it from India to USA? If so to which lockbox or service center we are supposed to send it?

We wanted to show a cosponsor. As my parents live and work in UK, can I show my parents as cosponsors who are residing outside the US?

If you're not yet married, then you should file K1 or file the CR-1 after you get married. You can send stuff from India to the same lockbox as you would if you were in the US.

Pretty sure that cosponsors need to live in the US.

April 27, 2016: I-751 mailed

Will you get married on this trip? If yes, you can send the I-130 packet once you are married and have all of the pieces, which includes the copy of the marriage certificate. Where you send the paperwork depends on your state of residence; see this link. If no, you and your fiancee can look into whether you want to apply for a K-1 (fiancee) visa and marry in the US after approval or marry first in either country then apply for a CR-1 (spouse) visa. Comparison between the two paths: link.

Sponsors of an intending immigrant have US domicile. If your parents live and work in the UK, they probably do not fit the criteria.

Yes we are getting married this month so we would file CR-1 visa.

Initially I am going to India for few weeks but not sure if I would continue being here till my fiancee gets her visa or I might come back to the US very soon.

If in case I am planning to stay in India for a while, can we send the petition from India stating the country of residence is India as I am planning to stay for about 4 months or so? if so to which lockbox.

If I am only for short duration in India then I am sure I have to send it to the TSC as my state of residence is MI.

If suppose I am short duration in India, can we still send the petition from India to the specific service center of my residing state in the US (TSC)

Ok, my parents are UK and Norway citizens, they cannot be the sponsors.

No. They have UK and Norwegian citizenship

If you are living in India temporarily for few months (Still paying taxes in US), then you can send your I-130 package to that specific lockbox in the US...

If you are going to establish residency in India (work there and pay taxes in India), then you can use Consular processing.
