#1- Me and my Filipina wife have been married for about 2 months. Should I list her maiden name (also the name on her passport) or her married name on top of the forms?

#2- What is the current filing fee need to bring when I have my initial interview?

#3 They are asking for my ex wife's birthday and I do not know it. Should I leave it blank or write a fictitious date. I have no way to contact her. I kind of think leaving it blank would throw off a red flag.

1. You guys are married now so you have to use her married name

2 check the filing fee at uscis.gov

3. check your personal documents and Im pretty sure youll find her date of birth

Answers:

  1. The previous poster was not correct in saying "You guys are married now so you have to use her married name." It's a matter of personal choice whether or to change a name. Furthermore, and this is more important; if your wife is planning to use her married name and wants it on her Green Card, then she will need to obtain a new passport with the new name. The name on the visa will be matched to the name on the passport and the name on the Green Card will match the name on the Visa.
  2. The current I-130 filing fee can be found on http://www.uscis.gov;the current visa fee can be found on http://travel.state.gov - Additionally, all fees related to the visa will have been paid prior to the interview taking place; however, there may be a fee to be paid to have the passport returned after the interview. This will require a country specific answer.
  3. Leaving it blank will not raise a red flag, but may result in an RFE. You know what you know and you don't know what you don't know. If you are unable to locate your ex wife's birthdate in any documents you possess, then attach an explanation. DO NOT under any uncertain terms write a fictitious date, period, full stop.
