Hello colleagues,

I (Beneficiary) need you guys to help me out. My wife do not meet the income requirements for Affidavit of support, so she wants to use her cousin income with hers.

I know that she must fill out an I-864.

Question:

1) Does she and her cousin have to fill out both the I-864, and the I-864A?

I found some conflicting and confusing information online, so I'd be very appreciative of any help!

Thanks

Does she literally want to combine her income with her cousin's? If so then she would be filling her own I-864 out and then the cousin would fill out an I-864a as a household member. Otherwise, two I-864's would be the way to go.

Your wife fills out the I-864 and the cousin also. The I-864A only comes into play if the cousin is married and files jointly with spouse and they wanted to use the spouses income also.

Remember cousin must meet the guidelines of her household plus the immigrant.

The petitioner is required to complete the I-864 form whether they meet the income requirements or not. If they are below the 125% of the proverty level then they are required to get a cosponsor or they can use assets if the value of the assets are 3X the short fall and those assets are readily convertable to cash and properly valued (appraised)--the primary residence and only car are excluded by the USCIS for inclusion as assets. The cosponspor completes their own I-864 form and submits their own supporting documents--i.e. tax transcripts, employment letter, bank accounts, etc--to prove the income and/or assest claimed on the form. The only time you complete the I-864a is if the

sponsor(s) live in the same house and they are combining their incomes. The cousins must include all dependants plus your wife to determine the poverty level that is needed to be met.

Good luck,

Dave
