He is of First Nations heritage so he is lucky that way.

OK

I just mean that the crimes I committed were years ago, and I stole a nail file. Not a car. Maybe I am looking at the wrong way, but I just think being punished for something I did as a teenager seems rather harsh.

May not be an issue, you need to find out.

I will consult with a lawyer, but what happens if I do not get approved for an i-601?

You go home

Because I am from Canada which is a great country (where I have no criminal record) we have a harder time getting a waiver? And therefore can not immigrate to the US

No, your arguments would be different to say Mexico but there seems no difference in approval rates. It is a game basically.

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

Go home and then I am not able to immigrate? And we are all of this money and time in a screwed?

I have not got the police clearance yet.. should I do that now? What difference will it make if it comes up clean since technically I do not have a record back home?

Not everybody gets to Immigrate. Couple of Drug charges, claiming to be a US Citizen and no waiver for example.

I would not have thought you are near certainly OK assuming you respond correctly.

You need to know what your record is, note USA wants to know ALL charges.

You seem really reluctant to contact a lawyer. It's your best bet. They may not give you the answers you want, but may give the ones that you need.
