My Husband is currently waiting on his AOS to be completed. We just went to do his biometrics last week in Charleston. We had intentions on getting his daughter to come over in a few years and we would visit her in between time but circumstances have changed. It would be more beneficial for her to come here with us as soon as possible.

Can someone please give me a breakdown on exactly what I need to submit and to who to get her paperwork started. She is only 5 years old. Would I need to pay the same fees as we did for his papers? Any and everything would be extremely helpful! Thanks for all of your help guys!

You'll want to file a "follow-to-join"

Required Documentation

  • Form I-130, Petition for Alien Relative (signed with proper fee)
  • Evidence of your U.S. citizenship:
    • A copy of your U.S. birth certificate OR
    • A copy of your unexpired U.S. passport OR
    • A copy of Consular Report of Birth Abroad OR
    • A copy of your naturalization certificate OR
    • A copy of your certificate of citizenship
  • If you are a permanent resident, you must demonstrate your status with:
    • A copy (front and back) of Form I-551 (green card) OR
    • A copy of your foreign passport bearing a stamp showing temporary evidence of permanent residence.
  • If your name or your child’s name has changed, proof of legal name change (may include marriage certificate, divorce decree, adoption decree, court judgment of name change, etc.)
  • Proof of relationship (see chart below for case-specific requirements)

Why did you not include the children on the I-129F? This would have been an easy follow to join, simply apply for the K2 visa as long as Dad hasn't had the visa for over 1 year, however now you'll have to file the CR2. I'm unsure if you can do it before he is an LPR or not but I think you can.
