6 Months Visa from UK...for parents???

Hi everyone.

We are just making some enquiries as I would like my parents to come over on a six month visa to stay with us while I have a baby, move houses etc. They usually travel on the visa waiver program but that only lasts for 90 days. They wrote a letter to the embassy asking about the situation and the embassy just told them to make an appointment. I was wondering if anyone had experience with this?? They are from the UK, have travelled here 3 times on visa waiver, own their own house, have my other family members at home etc........... Any input on chances of denial? Also what happens if the are denied - are they still allowed to travel on the visa waiver program?

09/06/2006 RFE email.....not sure what for yet!
9/07/2006 Biometrics completed
10/13/2006 Transferred to CSC!!
11/02/2006 Approval email received!!
11/08/2006 Welcome to USA letter arrives!

11/13/2006 GREEN CARD RECEIVED - NO MISTAKES!!!!

06/06/08 Family moved back to UK!!

Husband gained UK citizenship September 2015

Hi Sam,

My understanding is that as long as your parents can support themselves financially in the US and prove this to a consular officer, there is no reason why they would not be granted a visa to enter the US for 6 months. Their reason for the visit is very valid and as long as they have connections to the UK in the form of house, dependents, jobs etc then there is no reason they would be declined. In the event they are declined, they would still be able to travel on the VWP as UK citizens. Hope this helps.

Hi Sam

I only know of one person who has actually done this and she is not around any more unfortunately. She did however tell me that they had to go to the embassy for an interview but not what forms they required.. Is there no where on the US embassy site in London that can give you any further information. I'll try an find out some more for you

My parents were denied a B2 visa to visit for 6 months.... reason given, without jobs in the UK (they are retired) they did not have strong enough links.... they own there own home in UK have money invested, my handicapped brother is dependent on them. But still they were denied... they still travel over using VWP and have had no problems....

Sam,

Six months is the maximum allowed using a B2 visa, but the visa does not set the length of stay. The immigration officer at the POE sets the length of stay.

You forgot the most impostant piece of information, their age.

If they are 65 plus and obviously well past working age it should not be too much of a problem, Florida is full of snow birds on B2's.

Playing Devils advocate why do they need to be here so long, the reasons you give do not in themselves make much sense.

If refused, they can travel on the VWP but will have to declare the B2 refusal which guarantees a grilling.

I was under the impression that if you have ever been denied a US visa you can no longer use the VMP??

Not true, clearly stated on the US Consulate web site, plus I know from personal experiance.

I dont know what to say..have you tried to have them get a tourist visa?

Thanks for everyones advice. They have booked an appointment at the embassy which is in February, we'll just have to keep our fingers crossed! My father is 65 and my mother is 55 (but has been a homemaker for the past 30 years).

I would say make sure they go for massive overkill on the evidence of ties to the UK - whilst travelling here before getting K-1 I got stopped and grilled at POE the problem arises I discovered when you spend more than six months out of a 12 month (not NOT calendar year) in the US as they view that as thereby making this your residence as your here more than home. So wonder how their previous trips added to this planned trip would affect that 12 month 'rule'. Good Luck !!!

all in all they have spent 4.5 months here from Jan 06- Jan07......... so they are ok according to the six month rule right??

They are planning to take evidence of house, car, brother, grandchildren, dog etc anyone have any other suggestions??

We didn't know whether to tell them about me having a baby - not sure if this will work towards or against their case??? We are gonna work on all that stuff before they go.

Any suggestions are appreciated though

can they not just travel using the vwp and stay for 3 month which is what is allowed if I remember rightly and then come out in the next calender year for another 3 months, surely that would save all this hassle?? just a thought Sam

They can use the VWP for 90 days.

What are they going to say when they are asked why they want to go for more than 90 days?
