Hi everyone! My ROC will be in 2016, but I am contemplating of getting a divorce soon cause my husband cheated on me and he is not cooperating anymore in helping me to get my papers. we are leaving separately for 2 months now and he has posted tons of pictures on his Facebook with the mistress! I've consulted an immigration lawyer and according to her, divorce is an option to take. Need your help guys!!!!!!

Make sure you have evidence to show that the marriage was entered in good faith and not for the sole purpose of immigration benefits. If your a ROC is 2016, I'll assume you received your CPR this yr. it might be major red flag if you get a divorce so soon after getting a greencard.

As a recent divorce waiver petition filer, I would suggest you not take that route unless you have a lot of evidence and a solid case.

Make sure you have evidence to show that the marriage was entered in good faith and not for the sole purpose of immigration benefits. If your a ROC is 2016, I'll assume you received your CPR this yr. it might be major red flag if you get a divorce so soon after getting a greencard.

What evidences do I need to show to prove that our marriage is genuine? The only evidence that I have as of now are joint bank accounts, heath and life insurance. Other evidence like lease, car insurance, utilities I don't have cause he doesn't want to cooperate anymore. I received my CPR last May of this year.

Divorce and file I-751 with divorce waiver and evidence of bonfide marriage by yourself.

Yes, that's what I'm planning to do. I'm just so stressed out about this cause he just abandoned his responsibility to me.

If your name was on the lease/utilities/car insurance you should be able to go directly to those entities and request the documents without having to get them from your husband.

Day 0 - 2 May 2012 Mailed AOS package overnight delivery
Day 139 - 17 September 2012 Interview & APPROVED on the Spot!! :)
Day 145 - 23 September 2012 Received Green Card!

ROC - Eligible June 19 2014

Day 0 - 18 June 2014 Mailed ROC package via 2 day priority

Day 42 - 29 July 2014 Approval and Card Production Email

Day 49 - 5 August 2014 Received Green Card
