i-864 or i-864a

Hi everybody,

I was trying to figure out which form my joint sponsor needs to file. My husband is my petitioner ( the US citizen), but his income doens't meet the requirements. So we needed a joint sponsor.

HIs stepdad will be the joint sponsor. He has the same address but he is not a relative (by blood I mean, just by marriage). So, I am unsure which form to use. Does he just need to file an i-864 like my husband or does he need to file an i-864a?

And the household is my other question:

Me and my husband have two kids ( they have american passports so they're good). Is my husbands household size 4 or is it 5 (because the joint sponsor lives at the same address)?

And the household size of my joint sponsor, do I just count him and his wife. Or do I count him, his wife and me ( because he is sponsoring me) or do I count him, his wife, and my family because we will all be moving in with them (on paper) when I get my visa?

If they live together and wish to combine incomes then his stepdad would fill out the I-864a. He is, in a way, his dad.

Your husband will count his stepdad either way in the checkboxes since one asks if you have a parent, sibling, etc. combining incomes with you on an I-864a. (put 1 in that box)

The joint sponsor will add you, the immigrant, to their household size.

Use an i-864 and then an i-864a for the mother if she makes any income. Do not use an i-864a for the step father. They count 3 in their household (dad, mom, you) unless they have other dependents. Your husband counts him, you, and your children and his I-864

Last time I'm helping with the I-864 on here...I'm going to end up messing things up for people. Sorry, it's just too confusing for me. No wonder so many people get checklists.
