EVIDENCE OF FINANCIAL SUPPORT FOR FOREIGN SPOUSE

Hello,

My husband is about to send in his N400 application form. He has already petitioned for me. I do not live with him. What can we include to show any government order to provide financial support, evidence of financial support. he only sends me western union once in a while. i reside in Nigeria, and there is no court order compelling him to provide financial support. we dont have any kids yet. What do we do. I am fully employed in Nigeria and not dependent on him. What do we do now as he needs to get his citizenship for me to continue with my visa process. We are both Nigerians. Thank You.

Month/Day/Year 09/24/2013 - Priority Date09/26/2013 - NOA112/18/2013 - NOA2 - Approved01/06/2014 - NVC Received my case02/13/2015 - Received email to pay AOS/ DS-261 WAIVED02/14/2015 - AOS & IV Fees Paid03/06/2015 - Financial Documents and Civil documents sent to NVC03/09/2015 - NVC Received03/09/2015 - NVC Scan Date03/09/2015 - Ds260 completed and submitted03/11/2015 - NVC sent confirmation via email04/04/2015 - AOS Checklist 04/06/2015 -Response to Checklist04/07/2015 - New Scan Date04/30/2015 - Case complete confirmation via phone05/07/2015 - Received case complete confirmation mail06/02/2015 - Interview Date ( 2nd July 2015) over the phone 06/08/2015 - Interview Letter arrived via Email 06/15/2015 - Medical Test Completed06/10/2015 - Case shows READY at CEAC portal<p>Visa Approved, waiting to pick up passport :)

When he gets his citizenship he will need to update his petition at Uscis to reflect his new status. The western union receipts will be useful as evidence during your interview. You will also need to provide any other piece of evidence that shows an active on going relationship. Stuff like call and chat logs, pictures with friends and family etc. If he comes visiting then his boarding passes and flight itinerary would also be considered useful.

There's no such order he can get nor is it required. Since you are the woman and your husband is sending support to you that is good evidence to be shown.

But there's no court order or anything. Think you are focusing on the wrong thing. You need to show bonafide relationship evidence not financial. Immigration doesn't expect people who don't live together to have much cominging if you have it okay.You need to

show evidence with your petition of communications all his visits pictures wedding photos with parents friends and family.

If you have a dependent spouse or child(ren) who do not live with you, send:
Any court or government order to provide financial support; and
Evidence of your financial support (including evidence that you have complied with any court or government order), such as:
a. Cancelled checks;
b. Money and receipts;
c. A court or agency printout of child support payments;
d. Evidence of wage garnishments;
e. A letter from the parent or guardian who cares for your child(ren)
I am divorced with a mother of my kids. She takes care of them.She has a good job and she doesnt need my support. But I did sent money via Money gram and dont have receipts What can I send to cover this part of the check list?

Filing based on 3yrs/USC Spouse. 3 year residency anniversary is in August 2014. Filed immediately after the 90-day early filing mark (May 2014)

Thank You for your response, he has already applied and wud be going for his biometric appointment next week, I have a whole lots of support documents from 7yrs of relationship and almost 2yrs of marriage.

Tnx Dwheels76, he has sent in the N400 app on 22 Sept, so far no problems, he is scheduled for his biometrics by next week. Thanks for the response.
