Dear VJ members,

I need some help on the on the I-130 petition form.

I was married before to an alien here in the states and filed for his Green Card immediately after marriage and he was first issued a 2 years card and then later a 10 years GC and i left him because he was married with kids when he married me and the marriage was annulled because of Bigamy and facing deportation and jail term. Now am married and filing a spouse visa this time to bring my husband to the states. On the I-130 form i come across a question asking if i have ever file a petition in the past.

Because am filing a spouse visa, are they asking if i have in the past filed a petition for spouse or is the Green Card i filed for my ex all considered as part of it?

Thank you all.

You must tell them about the petition for your first marriage. I had married a British citizen in 1996, we applied for AOS and then abandoned it so we could return to the UK where we had better opportunities. More than a decade and a divorce later, and still living in the UK, I got remarried to another British citizen. When we decided to come to the States, I informed them of the abandoned AOS on my new I-130. This is what they wanted.

You live in Arizona so your lockbox is Phoenix. Standalone I-130 means you are filing for spouse that lives abroad and no other forms. The I-485 with I-130 are for when the immigrant lives in the US so they are adjusting status.

And yes you did petition your former spouse. So answer is YES.
