Confused about where to send the I-129

Hello,

This is my first posted question, but I have been looking at all the information that has been given for quite a while. I must say, this is an amazing site!

Anyhow, on to my question.

Where do I send the I-129 form?

Information:

- I am filing the I-129 (hopefully on Jan. 25th)

- I currently live in Thailand and have been living here for approx. 2 1/2 years.

- My last place of residence in the US was in California.

- However, I plan on living in Michigan when I return to the US with my Fiance.

Note: The instructions for the I-129 form state the following:

"If you live outside the United States, mail your petition to USCIS Service Center listed above that has jurisdiction over the last place you lived in the United States. NOTE: Your petition cannot be adjucated at a USCIS office abroad."

So, do I send the I-129 to:

California (since this was the last place I lived in the United States)?

or

Nebraska (since I will be moving to Michigan which is under their jurisdiction)?

According to this statement, I would think that the forms would go to California. However, it really does not make sense if I am going to be living in Michigan when I return.

If anyone can clarify this matter, I would greatly appreciate it.

18 Sep 06 - Received NOA2 in mail

11 Oct 06 - Case MNL783xxx received by Manila Embassy... guess NVC lied

26 Dec 06 - Received Packet 4

18-19 Jan 07 - Medical complete early, scheduled 8 Feb

19 Jan - CFO completed after SLE shots... have to go back for the stamp after visa approval

15 Feb 07 - Interview Approved

24 Feb 07 - Arrive at Honolulu POE

2 Apr 07 - Married, civil ceremony, mailed AOS

17 Apr 07 - Checks cashed for AOS & AP

22 Apr 07 - Filed Expedite for AP

8 May 07 - Biometrics Appt

8 May 07 - Filed complaint with local USCIS for no action on Expedite request

9 May 07 - AP Expedite approved via email

14 May 07 - received AP I-512L documents in the mail

25 Jun 07 - AOS Interview scheduled but cancelled due to deployment and family emergency

29 Nov 07 - Visited local USCIS to reschedule AOS interview

15 Jan 08 - Local USCIS finally forwards reschedule request after formal complaint

8 Feb 08 - Received new Interview date

28 Mar 08 - AOS Interview ..investigation reopened due to incorrect birthdate that was identified 05/07

16 Apr 08 - CRIS Notice of GC approval and welcome notice via email

25 Apr 08 - GC received finally!

15 Jan 10 - Mailed Lifting of Conditions Package

19 Jan 10 - Package received at VT USCIS

22 Jan 10 - Checked cashed by USCIS

26 Jan 10 - Received NOA dated 20 Jan 10

29 Jan 10 - Received NOA for Biometrics

I appreciate your assistance.

However, I already have the information you mentioned.

The real question is which address should I use as reference to determine where I file?

Choices are:

The address I am going to live at when I move back to the US - Michigan (which would require me to file in Nebraska)

or

The address I lived at 2 1/2 years ago in the US - California (which would require me to file in California)

I currently live in Thailand and that is the address on my application. I will be moving back to the US (hopefully) in May. I was considering staying in Thailand until my fiance's visa is approved.

Correct me if I am wrong, but according to the instructions in 12 A on the I-129 form, it seems that it is possible to file the I-129 while you are living overseas.

"If you live outside the United States, mail your petition to USCIS Service Center listed above that has jurisdiction over the last place you lived in the United States. NOTE: Your petition cannot be adjucated at a USCIS office abroad."

FORM I-129 (INSTRUCTIONS 12 A)

Again, if I am not going to live in California when I go back to the US (which was my last address before moving to Thailand), and I am moving to Michigan in May, do I still file in California?

USCIS will only correspond with you to a US address, so what US address is listed on your application? That is the answer as to where the I129F should be sent.

But the bottom line is it really doe not matter as it will all be processed in California. If you send it to Nebraska it will be transferred to California as neither Texas or Nebraska do I-129F petitions for K-1 anymore

Seems to me that the instruction you quoted tells you quite clearly where to file your petition.

One other point that may be of interest to you - I-129 is a petition for an immigrant worker. Is that really what you want?

Yeah send it to California, the last place you lived. It's better to send it straight there anyway. Sending it to Nebraska or Texas will take an extra week or more since they just foward it to California anyway. *impatiently awaiting California to acknowledge their check*

Does someone live at the US address you will be using if you use California office...because no matter what you need to make sure you are sending it to an address where someone can receive your mail...and since you haven't moved to Michigan or know anyone there to receive you mail...you best bet is to use an address where you can receive mail...

JAN 24-07 JUST FOUND OUT OVER THE PHONE THAT NVC SENT PETITION TO LONDON ON 1/12/07 & US EMBASSY IN LONDON HAS HAD THE FILE SINCE JAN 17TH 2007

USCIS will only correspond with you to a US address, so what US address is listed on your application? That is the answer as to where the I129F should be sent.

Can anyone verify this?

I live in Canada, and since it is hypthetically possible for a person to be legally residing outside of the states (I think anyway) at the time of the petition, I have some trouble believing this one... though I do I have a residence in the US and made a note about it in my petition. Just wondering if my mom should be looking for my mail hehe.

Oh... sorry, I am making reference to the I-129F (hense the K-1 visa forum posting).

I know the answer may seem obvious in this situation, but I am so stressed that I am going to make a mistake that will delay or negate the entire process (such as sending it to the wrong place).

Anyhow, I appreciate you advice and your easing of my concerns.

My *guess* is yes, since there are a few instructions for if you live outside of the US... but, I'm still waiting for someone to verify this too.

I found this information regarding a K-1 I-129F for Thailand

"2. Following approval, USCIS transfers approved petition to the Department of State’s National Visa Center (NVC) for preliminary processing. Upon completion of this processing, NVC forwards the petition to US Embassy Bangkok for visa processing. It usually takes approximately one month for the petition to arrive in Bangkok after its approval by DHS."

I am assuming this means that a person can file a I-129F while living overseas. Maybe I am misunderstanding the information.

I am also assuming that the same rules would apply to other ex-pats applying for the K-1 Visa abroad in other countries as well.

Are there any other interpretations?
