Question about I-864

Hey guys,

A quick question.. My parents are my joint sponsors for the AOS. Do I need to fill out two different I-864 for each parent or just one since they for jointly?

Also, do I need to include any kind of a letter explaining why there's no tax returns for me? I haven't worked in last three years as I was a full time student but I also wasn't a dependent on my parents taxes even though I live with them.

hi

you file the i864 as sponsor and submit the letter explaining why you haven't filed taxes. Your father files an i864 as your joint sponsor and your mom files the i864A as his household member

May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

July 23, 2025:  Filed N-400 online

Hi, Either parent can fill out the I-864 and the other fills out the I-864A. Personally, I would have the parent with the higher income fill out the I-864. Remember that you still have to file your own I-864 even if you had 0 income or no taxes.

If you weren't required to file taxes because your income was too low or didn't have any, include a statement in the form of a letter where you explain that you didn't file taxes for such years because you weren't required to file because such and such reasons. I'm not sure if it has to be notarized, I had mine notarized since it's only $2.

If you weren't required to file taxes for reasons other than low or no income, you also have to include proof of the IRS regulation that exempts you from filing.
