Hello,

I applied for IR-1 Visa for my wife of 6 years and my step-son. I received approval on one of the visas from the California Service Center but the other is still under initial review. Are they normally approved together or usually one way before the other? I don't want one visa to be 6 months behind the other, which is why I filed them together. Anybody have any thoughts or been through the same type of experience?

To clarify -- neither visa has been approved as of yet. One of the petitions had been approved, right? They are adjudicated separately, so there is never a guarantee that they will be approved at exactly the same time. However, you can bring them back together by controlling the timing of the information you submit to NVC. The approved petition won't move forward until you complete the NVC stage, so just don't finalize it until the second petition is approved and you should be OK. Once ready to proceed with both, wouldn't hurt to call NVC and let them know your goal of interviewing at the same time so they will likely try to schedule them that way.

I applied for my wife and step daughter together, they went through the California service center and both were approved on the same day and sent to the NVC on the same day. NVC approved my daughter one day before they approved my wife. Come time for the interview appointment NVC forgot to make an appointment for my wife so I had to request for an expedited appointment for my wife from the consulate. Fortunately they accepted the request. I would not sit on it and wait until they do something, I would start calling USCIS. From all the information I received the two cases were linked and should have been processed at the same time.

9-16-13 I-130 Mailed

9-20-13 NOA1

3-04-14 Transferred to CSC

3-12-14 NOA2

3-26-14 Received NVC

5-3-14 Received DS-261/AOS bill

5-3-14 Paid AOS bill

5-3-14 Submitted DS-261

5-8-14 Mailed AOS Package

5-8-14 Received IV bill

5-8-14 Paid IV bill

5-9-14 UPS documents to NVC

5-10-14 Sent DS 260

6-12-14 Case complete

9-8-14 interview---- approved

They don't always approve together. My friend was at CSC her and her 2 daughters she was approved. CSC transferred her daughters to TSC which wanted an affidavit from the father (who they have not seen in over a decade sign and give permission that she can bring them to the US) That took about 4 months of delays. They are still messed up at NVC all being separated weeks apart.

You should call to see whats up.

I would only submit the ds-261 at the NVC while waiting for the child's approval. I would contact your congressman to see what can be done.
