Hello,

We've been married for 1 year 8 months and my American wife received a UK VISA after marriage and we have been living in the UK (The UK has a great 2 month VISA process!!!!) She has now moved back to America after struggling with the UK job market and I'm looking to follow. We are going to start the IR-1/CR-1 VISA process and start our long wait. However we are unsure when to submit the claim?

I've been reading if you've been married less than 2 years you get issued the CR-1 and then to get the IR-1 you need to reapply and pay something in the area of $600 to change your CR-1 to a IR-1?

However we are 4 months away from being married 2 years. I would prefer not to wait an additional 4 months till we can start our VISA process. However we aren't sure if we submit the I-130 this week the date on the application will be during our <2 year marriage and we might get a CR-1 which will instantly be out of date and have to reapply for the IR-1 and pay even more money.

Has anyone come across anything similar or know of any resources to point me in the right direction?

Whether you get a CR1 or IR1 depends on how long you've been married when you enter the US at the end of this whole process. Start now as this can take up to a year for start to end.

So as long as I enter the US after our 2 year marriage decides if I get the CR1 or the IR1?

Just don't want to get caught out and have to renew and spend an additional $600

We got married June 22nd and we started September the same year and we were on CR1 route but after scheduling our interview, i was surprised that they have upgraded us from CR1 to IR1 automatically because june 22nd, 2014 was our two years anniversary, i called NVC and i spoke with one of their workers and he told me that we have been upgraded to IR1 because our marriage is now 2 years old. So i would suggest that you start right away, you are only 4 months away from being two years, this process will probably take between 1 year to complete and they will upgrade you to IR1.

Before when we got checklist, they used to write CR1 but now they wrote IR 1 on our last two checklists and that is the reason why i called to verify until i was told we've been upgraded and also our interview letter says IR 1. so its better to start now. I wish you best of luck in the journey.

Had you started the process while your wife was still in the UK you actually would have had a much easier/faster time of it all. Can she still legally reside in the UK? There is an option called DCF and London is one of the few places in the world where it is available. You would cut your immigration time down to 4 months vs over a year.

Do you have any more information on this????? my wife's UK VISA is still valid for another year and she could come back at anytime but only for short periods of time.... She already has a job in America but I like the sound of cutting the duration down to 4 months!!!!
