hi everyone,

im currently still an f-1 student, i got married a couple months ago and im sending my papers in a couple days so i have a couple questions about the AOS forms.

-on the i-485 part 1. under "expires on" should i put D/S which is what my i-94 sais, or should i put the date my last i-20 form expires? my i-20 exires on august 18th which is next week so im trying to send everything asap while im officially still in f-1 status.

-i havent worked in the US as i was an f-1 student so i never filed taxes. do i need to attach some kind of explanation why im not submitting my tax returns, if so in which form should it be? or is it understood that i havent worked because i was a student the whole time?

(1) I believe the "D/S" stands for "duration of stay" and refers to the date on the I-20. I am currently adjusting from J-1 and mine is similar. On the form I wrote "D/S" and then in brackets I wrote the date on my DS-2019 (which is the equivalent of the I-20 for J-1 holders).

(2) If I recall correctly, the I-485 doesn't ask for tax records. Why do you think it does?

You do not need to attach your tax forms, it's your spouse or sponsor who need it.

08/25/2014 - Notification for the interview date on 09/25/2014

09/05/2014 - Notification for EAD card being re-mailed

09/08/2014 - EAD finally delivered!

09/25/2014 - Interview at the Memphis Office - Approved!

09/29/2014 - Welcome Letter delivered

10/02/2014 - Green Card delivered!!!

-You would write "Duration of Status".

-On the actual Form I485, it will not ask for tax information; however, in the instructions, it does state to include the Form I864 (Affidavit of Support). The tax information requested in this form is for your sponsor/joint-sponsor. (As an F1 student, you are legally not allowed to work anyway.)

When sending in the I485, it states to send in other forms along with it (i.e. medical records, affidavit of support, etc.). most likely, the OP was asking about tax info for form I864.

thank you so much for your help!

i have another related question, so my husband is not making enough to support us but he is still required to submit the I-864 and show his tax return, yearly income etc. so i just want to make sure ive marked both his and the joint sponsors I-864 correctly for this kind of scenario.

I-864

-in part 1, under 1.f i checked the box saying "i am the first of two joint sponsors" and in my joint sponsors form i checked the box saying "second of two joint sponsors" as this will be the sponsor actually supporting both of us, as my husbands income is really low for the last tax year as he wasnot working much

-in part 3, under question one "i am sponsoring the principal immigrant named in part 2" i checked the box saying "no" in my husbands form

-in part 5, when asked about total household size, under question 1 i wrote he number 0 as he is not sponsoring me, under 2 "yourself" i wrote number 1, and under 3 "if currently married" i put the number 1 for myself, the spouse, so under question 8 the total household size is 2

-in part 6, i checked the box under number 4, for unemployed, as he has been unemployed since february 2013. is there any document necessary to prove that? he hasnt been collecting unemployment in the meantime, i havent found anything about that in the form instructions.

Let me know if you think and see something that needs to be changed! And thank you again so much, this forum has been so helpful in preparing my application!

I need to send everything by tomorrow so today im going through all the forms again tripple checking and making sure everything is in order. Also, i filled out most of the forms on my cimputer and then rinted them, looks better and is easier to read. however some fields are not so user friendly, for example the dates dont fit int he designated date fields, so after printing i filled only those ones by hand using black ink. i guess thats probably ok, having it half done on computer with some of it done by hand?
