Hello fellow Journey Member,

Step son is getting ready (About dang time lol ) to apply for his cistizenship, however he can not find his old passport with his exits and entries. I look up that we can do an FOIA request. Do i just make a letter or is there a sample one here that did nt come up when i searched. Thanks for the help as always....... we still have 3 more for citizenship but funds are low and all that jazz :rofl:

Why is it that the only one who can stop the crying is the one who started it in the first place?

How many trips are we talking?

FOIA can take upto 12 - 18 months. Best way would be to check email or other records to see if you can figure out the travel dates or you can provide estimates dates if the trips are few.

Also, IO may need to see the old passport. Did you file a lost passport police report?

Were any of his trips within the last 5 years? Also were they less than 6 months? He can estimate the dates or check his emails with airline receipts or something. They shouldn't make his life impossible for not having the passport if he lost it.

My grandma didn't have all of her old passports when she applied and we just put in estimates of the dates. It can depend on the officer, but he should just be ready to explain. The important thing is that the trips aren't more than 6 months because it could interrupt the continuous residence requirement.

This is not an issue.

The USCIS recognises that documentation by an applicant for naturalisation of all trips abroad within a five-year period may not be precise given the time span. With discretion, it permits applicants to make "good faith" efforts to document all their international trips to the best of their ability. If either or both the applicant and the immigration officer adjudicating at the naturalisation interview believe that the threshold for Physical Presence and/or Continuous Residence have been breached, travel records could be accessed by the USCIS and/or the applicant could then be instructed to provide specific documentation.

The bottom line is this:

1) If your travel abroad has not been excessive in your statutory period, document what you can remember on the forms and explain the lost passport scenario at the naturalisation

2) To be credible, it is imperative that you provide paperwork that demonstrates that you have declared any missing passports as lost or stolen.

3) Do not bother with the FOIA. The marginal benefits are too far outweighed by the costs

Thank you Every one. Long trip he took was to Spain for a try out with a team there. He has been back to colombia a few times for a month or 2 at a time. Now to try and find somewhat dates lol. No report filed as far I can can remember so will do that upon his return from Colombia this time Love this site :)
