Hi there, did your I/O who interviewed you said directly to your face that he needed you to come again for the second round on the same day??

To answer your question, the immigration officer said my application was fine, but that he wanted to review certain aspects of my application and that he would be best served if I provided him additional documentation. At first, he wanted the additional documentation to be sent in the post (which may then have been categorised as a formal Request for Evidence in the USCIS case processing, who knows!), but then he decided the best time-saving approach would be to simply re-interview me with the field office supervisor and review in-person the documentation I had been instructed to bring.

My interview was on July 1st.

On August 7, 2014, we received your response to our request for evidence. This case is being processed at our SAN FRANCISCO, CA location.

What is going to happen next? Am I going to get rejected or Denied? I am scared.

Hello:

Did you have any criminal records which might be serieuse?

1) your daughter: if your daughter is in the US, she is a US. Citizen already. Her status doesnt depend on your at all. That's her birth right and nobody can take it away from her as she was born on American soil.

2) your wife: as long as your wife has an I20 and attends school as a full time student she is totally fine and her visa is still valid. She can travel whenever she wants to and get back k in the US as long as her visa is not expired.

3) if you are an LPR, you shouldn't be afraid either, you are legal in this country. You can work provide for your family. As long as you meet your requirements and you dont have major convictions you are good. Speeding tickets aren't bad, I had four and I passed.

I seen people who had your situation. Ones whose status online changes to RFE and they dont receive anything. I believe USCIS is trying to buy time for reviewing your file. 2nd interviews are not uncommon either. Officers might want to shed some light on area he forgot to ask about earlier.

You have to remember, officers do their best to find absolutely everything about you before granting you citizenship. Once you are a citizen they have to take you to a court and they have to prove that you don't deserve to be a citizen. A hassle they don't want to go through.

Be patient you will hear the good news.

Alrighty I am keep my post update. Hopefully it will be good new for me. About my wife. Her Visa is expired but her I-20 is currently valid. As for my daughter, she is born here. So my problem for her is:

Will she has problem coming back from China? With VISA renewal there? She is afraid that she might be rejected because she is married in United States. Will the immigration officer think she has intention of immigration when she renew her student visa in China?

Before approving her F-1, the consular officer will ask her questions to make sure that she doesn't intend to live in the US permanently. That will be very difficult to demonstrate since her child is a USC and her husband is a permanent resident. I would say that there's a significant chance that the visa would be denied.

Yesterday I received a letter from USCIS.

2) Alien Registration Card (GREEN CARD)

3) ALL PASSPORT or any documents you have in connection with any entries into the United States.

What is this about? Am I going for interview again?????

No, I do not know what your letter is about. However, using logic and anecdotal evidence, I can speculate:

1) The worst case scenario outcome in the submission of an N-400 application is a denial. Denials are ALWAYS communicated in writing and sent in the post. They are not, for legal and obvious reasons, communicated in person. Therefore, we can logically surmise that this summons is not a denial and that your application is in continuance.

2) The best case scenario outcome in the submission of an N-400 application is an approval. Approvals are rarely delayed if it is known that an application has already been approved. Further, approvals do not normally precede a summons such as the one you hold in your hand. Therefore, we can similarly surmise that your application has not been approved...yet. It appears to be simply in continuance.

3) The likely scenario following from 1) & 2) above is that your application has not been denied and that the immigration officers wish to clarify a few points with you in-person before handing you an approval.

In my opinion, the summons is a little curious for the following reasons. Please note that these reasons are not to alarm (you seem to have enough of that going on, and it is not my wish to feed paranoia), but to make educated guesses and prepare you accordingly:

1) Why does this summons ask only for you to report with the summons and your Green Card?

If they wished to consider further evidence, they would undoubtedly have asked you to send in, or report with, specific items of evidence. The most logical interpretation of this scenario is that the USCIS has enough information to make an in-person decision (which, as stated in 1) in the first argument cannot be a denial) and needs to clarify a certain point with you in-person

2) Why does this appointment take place so far in the future?

Unless your local field office is busy, I would have expected them to have invited you in within a shorter time-frame. However, it is curious to note that lead times for interviews (the moment from receipt of the letter to the date of the interview) is about four to five weeks for stanadard naturalisation interviews. Based on this, my guess is that they wish to interview you again, but based only on the evidence that they have already received from you.

3) What is San Francisco's usual process for handling Request For Evidence RFEs?

I have zero familiarity with the San Francisco office, and am unfamiliar with how they follow up with RFEs. In your case, I understand that you did not receive an RFE per se, but you are being treated as though you received one. Is it possible that this summons is related to the San Francisco's local field office's process for closing out RFEs? I'm not sure.

So, what can you do in the meantime?

1) Relax! Examine things in tranquil perspective (San Francisco, with its numerous yoga classes, is a great place to do this!) and try not to worry, Joel.

2) Call the Customer Service Centre, insist on speaking to a Tier II office, and find out if they can give you information about the nature of this summons

3) Attempt to visit your local field office ahead of the summons to determine the nature of the summons

4) I acknowledge that 1) through 3) will not necessarily be possible, but you can review your N-400 application inside out (you kept good records, correct?) so that you are prepared for your summons on the eleventh of September.

An N-430 generally requires that an applicant surrender all prior US entry documents in his possession at an in-person examination immediately prior to his naturalisation as he will no longer have use for them.
