Hi...

Newbie here and I'm extremely glad that I found this site! I have a few questions but I will give a bit of background first.

My husband came over here 10 years ago on a tourist visa form England and never went back. We met 5 years ago and married in December of 2012 (I am a born US citizen). I went to a lawyer and they wanted so much money for their retainer plus the filing fees....and honestly I just don't have this kind of money. So I thought I would try this on my own.

I'm now starting the process for his AOS and have a few questions.

1. Given my situation should I hire an attorney? With him being overstayed so long? Is it possible for me to do this on my own.

2. On the I-130 form Section C line 14, where it asks for the I-94 number he does not have the original I-94. I have his passport with the stamp of when he Arrived and Date of when he should have departed. Will this suffice?? And if so do I make a copy of that page along with the info page in his passport to include with packet.

I have not even gotten to the I-485 yet.....I'm sure I will have questions on that as well :dancing:

Thanks in advance....all the help will be greatly appreciated!!

Length of stay does not matter, and most people do it themselves here.

It would be an I 94W, would have been stapled in his Passport, you can get a copy but that takes time. They do not do that now but certainly did 10 years ago.

I am a Florida native USC and filed for my spouse concurrently (I130 and I485 together). I did not hire an attorney, as the instructions that accompany the forms are pretty self-explanatory. Just make sure you read and double check your work before sending. It took me about 7 hours to fill everything out and I did it in one sitting.

1. The hiring of an attorney is up to you. Some people use lawyers, and others don't.

2. Regarding the I94 Card, you could try to go on the CPB website and fill out the information and see if you can electronically print it out.
