Hi everyone!

I'm British but currently living and working in the Netherlands and hoping to apply for a K1 visa together with my fiance (the US citizen) soon. I'm just wondering if anyone has any experience of going through the process while living in a foreign country. Would it be a lot easier or faster if I were to do everything while living in the USA or should it not make too much of a difference?

Hi there! Welcome to the forum! :)

Your US citizen fiance has to initially file for the I-129f petition in US. Once approved you can apply for K1 visa at the US embassy of the country where you currently [and legally] reside, which is Netherlands. This can't be done inside US.

The I-129F filing fee must be paid in US funds, drawn on a US bank. Many folks filing from overseas mail their completed petition packet to a friend or relative in the US. Have the friend of relative insert a check for the filing fee, made out per instructions, and then mails the entire petition packet to the Lewisville, TX lockbox location.

Do you currently have a visa that allows you to live in the USA?

August 2000: We start e-mailing. I'm in Bosnia, she's in Florida

October 29th 2000: She sends me e-mail asking if I would marry her

October 29th 2000(5 seconds later): I say yes

November 2000: She sends me tickets to Orlando for when I get back

December 6th 2000: Return from Bos

December 11th 2000: Fly to Orlando, she meets me at airport

December 22nd 2000: I fly back to UK

January 3rd 2001: She flies to UK (Good times)

Mid February 2001: Pregnancy test Positive

Mid February 2001: She flies back to US

March 2001: Miscarriage, I fly to US on first flight I can get

May 2001: I leave US before my 90 days are up

June 2001: I fly back to US, stopped at airport for questioning as I had only just left

September 2001: Pregnancy test Positive again

September 2001: She falls sick, I make decision to stay to look after her as I am afraid I may have problems getting back in.

April 16th 2002: Our son is born, we start getting stuff together for his passport

March 6th 2003: We leave US for UK as family

Early April 2003: Family troubles make her return to US, I ask Embassy in London about possibilities of returning to US

April 16th 2003: London Embassy informs me that I will be banned from the Visa Waiver Program for 10 years, my little boys first birthday

June 13th 2006: I-129f sent

August 11th 2006: NOA1 Recieved

After our relationship breaks down she admits to me that she had never bothered to start the application process

Thanks everyone for the response! I think autocorrect might have ruined my question, sorry! I wanted to ask whether it would be easier to go through the process while being in my home country of the UK or than in the Netherlands where I currently live and work. Thanks again to everyone for your help!

I don't think the difference in processing between UK and Netherlands would be significant during the embassy stage. You can continue living in Netherlands while the I-129f is in progress. What you can do for now is probably check out the K1 visa requirements/ instructions in the Netherlands and see if you can readily have those documents by interview time, but this is still a long way down the road. :)

Thank you everyone for your heartfelt replies! Thank you @sweetcakes I will be sure to check it all out in advance. And thanks @Jacque67, I also lived in Germany for more than 6 months so I think I will need to get a police record from there too!
