Called NVC again today, they told me my checklist for DS-261 was a misprint and it should have been checklist for DS-260. My new scan date is when I got confirmation for filing out the DS-260 form which is 4/16, so 45 wait again begins from that date.

what?!

oh FFS :( :(

***sigh***

I'm waiting for the DS260 to become available for us to fill out (probably Thursday or Friday).... if they make that our new scan date I'll be really upset! It wasn't *our* fault it took them so long to invoice the IV fee and such.....

**sigh**

Hopefully it was just one of those "say whatever I want" pain in the rear reps and praying they were wrong!!

July 18, 2014 - Married in Fiji
Aug 21, 2014 - Sent I-130
Aug 26, 2014 - I-130 recieved
Feb 12, 2015 - I-130 Approved!
Mar 6, 2015 - NVC receieved our case (found this out on Mar 11th phone call with NVC rep)
Mar 11, 2015 - Called NVC, was given case # & invoice #
Mar 11, 2015 - Paid AOS Bill
Mar 13, 2015 - AOS Fee deducted from bank account
Mar 14, 2015 - Received DS-261/AOS Bill (in mail)
Mar 16, 2015 - Called NVC, was instructed to mail out AOS/I-864, mailed I-864EZ/AOS/Documents (2 day shipping)
Mar 18, 2015 - Packet received by NVC, AOS Fee marked as PAID on ceac.state.gov website

Mar 23, 2015 - Called NVC: 1.to verify packet received(was told to allow 60 days for review) 2. to ask if DS-261 was entered in the system (was told case is too new to revivew over the phone, but I could call back in a few days if I wish to see if we could review it over the phone)
Mar 24, 2015 - Called NVC and was able to review DS-261 over the phone; added emails, designated self as agent of choice. Should be able to pay IV Fee & fill out DS-260 in one week (31/03/15)
Mar 25, 2015 - Paid IV Fee
Mar 26, 2015 - IV Fee shown as 'Paid'

April 1, 2015 - Medical Exam in Suva, called NVC for update on case: said it wasnt in the system yet, still in review. allow 45 days for case complete (hey, thats better than the 60 they said earlier!) They will only email us if they need further information, otherwise expect interview letter in the mail.

April 7, 2015 - Called NVC to follow up, no update given

April 14, 2015 - Checked ceac.state.gov website, saw that there were 3 N/A's, called NVC to verify that case was complete

April 15, 2015 - Received false checklist, called NVC to verify that was actually false checklist (re: police certificate would be sent directly to embassy and therefore was not included with support documents submitted in IV Packet)

April 16, 2015 - Called NVC to re-verify that received false checklist. Confirmed AND was told that interview date was scheduled

May 28, 2015 - Interview Scheduled at 8am, Suva Embassy (need to reschedule due to conflicting obligations)

Woohoo!!

DS 260 just became available for my kids and I...... I know what I'm doing for the rest of the night!!

:D

.....so two hours later, three DS-260's are done!! Woot!!

Mine was the most time consuming as I had to really go through the ole memory banks for all the addresses I've lived at since I was 16 years old (TEN of them!!) But the kids' was pretty easy.....

Though I did giggle at the 'security questions' at the end.... for oldest daughter I was tempted to say yes for terrorist - she's just starting puberty!! That's pretty darn scary and living with it is terrifying!! ((as I am sure anyone with a daughter would understand and also see the humour in this!!))

Hi Dear!!!

Ahhhh well.. The Great was right in that we did not get good news out of the second eRequest. Husband has an infopass appointment on the 30th. We are at 8 months and 20 days with no news of the status of our background checks, other than they are pending.

This is beyond sad, it has put a lot of strain on our relationship but we have managed to accept it and move on with our lives as they are now.

The lawyer replied to us a week after we told her what our "updates" on the case were. Yes, they had the nerve to send us an email with the subject line: "Any Updates?"

Unfortunately, at this stage, our options are very limited. Although the normal processing time for I-130s is 6 months, many petitions exceed that window. If the petition is pending for about 16 or so months, we could sue the government for their delay.

You can try reaching out to your Congressional representative. You can call him or her and show him or her a copy of the petition that was filed.

Please let me know if you have any other questions.

I asked her if she had any suggestions for the Infopass appointment... and moreover, if she could send us the copy of the final petition they sent after they first one was sent plagued with errors by one of their paralegals. I doubt she will take a look at our email before Apr 30th.

I don't want to sound gloomy or snappy.. but i just wanted to share in hopes this serves someone else in our shoes. Hopefully not that many are going through this endless wait in the USCIS limbo!

So.. long story short.. no updates other than an Infopass appointment coming up, a trip to SF to see my husband if we can find an appartment until May 15 or so... and a business trip in August to DFW...

I would go crazy if I didnt have a job, a cat or family and friends to support me. I really think about these things when I get mad at my husband. He is doing everything in his power and he is there missing me, the cat and all the family that loves him. :clock:

Hi Una.

You know what. Only a very small fraction of the immigration lawyers out there are thoroughly dedicated ones. Ever heard the saying "lawyers are a dime a dozen"? Well, it holds truth vry much in this area.

So, unless you are getting yourself the most practiced and reputable "ballsy" attorney/law firm in troublesome immigration cases, your're simply better off doing this on your own without the exorbitant "retainer" fees for practically doing nothing - by that I mean that immigration attorneys charge quite much for little effort on a matter like yours. You can do it, and you can do so starting on or near the 12 Month mark on your case. PM you in August with specific instructions (hopefully your wait won't carry on so far...).
