AOS Joint Sponsor.

Hello all,

I am currently living in Bogota, Colombia with my wife. I do not have an income in the United States for the previous two years, but I plan on moving back in two months to begin working in the United States. I just paid the AOS Fee and I am planning on using a joint sponsor for this process. The person who is going to be a joint sponsor lives on the other side of the United States. Does the joint sponsor need to share a residence or just prove their ability to care for beneficiary financially? I am confident about working when I return, but at the moment I need the joint sponsor to continue the process. Any help with this would be much appreciated.

No, you do not need to live with the co-sponsor. Sounds like you're good to go as long as the co-sponsor has enough income.

No, the joint sponsor doesn't have to live anywhere near you as long as he lives in one of the states or territories (Puerto Rico, Guam, USVI, etc) Also he doesn't have to be related to you or your spouse in any way. As long as he makes enough without combining his income with yours.

I have not received any of the paperwork, but I want to begin filling out all the paperwork now. My payment just processed today and is now paid. What paperwork will I need for the AOS process. I know we both must fill out I-864 and send all our financial information, but is there another form we must fill out? Do we need to fill out the I-864A? What other paperwork should I prepare now? Thanks in advance for all your help!

You can get the forms here, at www.uscis.gov/forms

So you would need to file an I-864 for yourself based on your current situation by the time you submit it.

Therefore if you are not working or don't have any other income to include when you file the AOS, you state in the form that you are unemployed. If you are working by the time you submit the form, then you can put on the form what you will make by the end of the year. As well as proof of that employment.

You would also need a letter stating why you didn't file taxes the previous years, and it's simple, you were unemployed.

For your joint sponsor, he needs to fill out an I-864 and if someone in his household is combining their income with him, like his spouse, they would need an I-864A.

He would need his tax transcripts, letters of employment/paystubs, as well as proof of citizenship or LPR status. Also if he is using any assets to meet the income requirement, he would need proof of those as well.

Refer to the instructions of the I-864 for more details. After you go over the instructions for the I-864 and you still don't understand something just ask.

Hello All,

I have it seems a common question regarding the Affidavit of Support. I am the petitioner for my wife filling out an AOS form and I am currently living with my wife in Colombia and have not lived in the United States in 2 years. A good friend in the United States will be my joint sponsor, because I am not currently employed in the United States. I just began filling out the AOS form and I came to Part 3. I am sponsoring the principal immigrant named in part 2. Yes or No? What do I answer? Thanks in advance for your help!

This is a good place to start, but you really need to start reading the NVC wiki found here: http://www.visajourney.com/wiki/index.php/NVC_Process

You should be able to see what applies to you. As a side note, are you a USC? If you are and you've been making money and not filing taxes in the US, you might run into some problems. You have to also submit with your I-864 your previous tax returns (or transcripts) from at least the past year and up to three years. So, you need to have filed taxes for 2011, 2012, and 2013. Even if you want to go with the "unemployed" route, you still need to do your taxes every year - regardless of if you made money and regardless of where you made money. You generally don't need to pay anything, but you need to do them. EDIT: I might be wrong about this. In any case, I've read conflicting information and I'm not comfortable enough giving advice about this. Anyway, read the wiki and good luck!

I can't stress enough - read the wiki. I thought the I-130 process was very difficult and now that I've completed just the AOS part of the NVC process, I can tell you that it's much more complicated and requires a lot more than proving you're married.

I would start now also reading about how you can re-establish your "domicile" in the US. This is an important factor for you. These things and more can all be found in the wiki.

The reason I am waiting is because I am currently in Colombia like I said and I will be moving back to the United States to start working in October and I want to wait until then to send out the AOS papers for obvious reasons (domicile and employment) which I want to have regardless of my joint sponsor so I run into no problems. Will this cause any problems? How much time after you pay the AOS fee do you have to send the I-864?

You have one year every time you communicate with the NVC. So since you paid the fee, you have a year from that date. If you take 3 months to send in the paperwork, that's within the year, and then your year would reset.

One Year Contact Requirement

After you receive notification that the NVC is processing your case, you must contact them at least once a year. If you do not contact the NVC for one year, all documents and fees on your case will expire and you must resubmit them to resume processing.
